In December '05 I borrowed $340 from this company. They sent me one confirmation email to confirm my loan. I then started to pay them back 2 weeks later at $90 every Friday from my bank account.

After a few months probably February '06 I began to get suspicious as to how much I still owed them and why they hadn't sent me a statement or emailed me anything since I took out the loan. I am always very diligent and check my bank account online at least every other day to make sure I am not overextending myself and to see when things I buy or pay for are posted. As I said they never emailed me a statement of what I still owed, though I did have to original email that said it would be $90 every 2 weeks and it would be automatic renewel. Wel the thing is that I didn't really need or want to renew after the first time. I went on their website and emailed them with no reply, I even called the customer service # on their website and it was a big maze.

In february I tallied up how much they had taken from me so far and it was almost $600.in March I put a stop payment on them wtih my bank since I figured if they were not going to respond to me then I was not going to continue to give them my money. I put the stop payment on a Wednesday and that same Friday my very smart bank Wells Fargo, still authorized the ACH debit of $90 plus United Cash Loans also took and additional $50 for a total of $140 in one day. Well of course I caused a stink at my bank since I put a stop payment on them and they still paid them. My bank recognized their error and promptly credited my account for the $90 but not the $50.

Then 1 1/2 weeks later on a Thursday I got my paycheck and went into my bank to close my account and open a new one so they couldn't get anymore of my money, my personal banker suggested this. So I arranged for her to close my checking account the next day and open me a new one (I still had a payment pending on my account). Well... That same day United Cash Loans decided it would me a good idea to present a paper check to my bank for $415. Well you guessed it Wells Fargo cashed it even though there was a 3 week paper trail of me complaining about this company and not to give them any of my money.

I found out about this check on Saturday morning when i checked my account online (diligence!). Friday is when I saw that I only had $8 in my account.

The check they produced to my bank for deposit was fraudulent in every way imaginable. It was printed off of their computer and said on the signature line that "Signature Not Required" and on the memo line said "Telephone/Fax autorization obtained 3/14/06" As I said before I had not been able to get in contact with anyone there! I also do not have a fax machine and my # they had on file was not in service on that that or that week for that matter.

I promptly called the Police and made a report about this and then went to my bank that same day. What they did was called a "Demand Draft" and it is in the process of being made illegal by almost all 50 state Attorney Generals. They commited a Federal Crime by conjuring up a check without my autorization and presenting it for payment. So I submitted a fraud report through my bank that very day. My bank made a huge error by honoring the check from the company and the company commited a crime. They bold faced lied on a legal document (the check) by saying I autorized it (which i would love for them to take me to court to prove) and profitting from bank robbery.

They cannot do this!!! I doubt I will see any money coming from them for all this over payment but the fact that I can prove they commited a crime is a very good start. I do not know if they will be able to harrass me because of this because my bank did withdraw the money that they gave them and credit me back. That account is now closed by the way.

I wanted to know if anyone else has ever experienced this with this company or any other? And what are my legal grounds to sue them? Also can they still come after me for any payment or not? I have given them about $1000 since January '06 for a $340 loan.
