Dishonest Lender Poor Company to do Business With ripoff

When applying for a mobile home loan in 1997, Green Tree informed me that I would not qualify for a loan, but suggested that I have a relative or friend apply for the loan on what they called a 'buy-for' program.

They explained that if I made the payments with a verifiable payment means (personal check) for one year, that they would then transfer the loan to my name.

After a year of always on time payments, I called them as did my Father (he received the loan in his name on the 'buy-for' program). They then stated that my father would have to send the request in writing which he did.

Then we called back and they acted like they had never heard of this before. I was a bit miffed, but willing to live with it. I continued to make payments on time.

In my father died and left me the home. I contacted Green Tree (by this time DBA Conseco). We once again asked for the loan to be placed in my name (I had never been late on a payment yet and had excellent credit) - they gave us the run around again and would not allow it.

Through probate, we had the title of the home transferred to my name at that time. I continued to make payment on time.

In March of this year, I had some financial problems related to car problems. I knew I would be late on a payment and I called Green Tree to ask for a deferred payment or at least to work with me on a late payment or two.

When I asked about a deferred payment, the gentleman in customer service asked how many payments would I need to defer - I responded that only one would allow me to keep all other payments on time. He then stated that they only do 3 month deferrals. So I asked if I could get a 3 month deferral and he responded that I could not?!

I then asked him to note the account that I would be late on a couple of paymnets.

Payment due April 20 was late and I got harassing calls all hours of the day and night. I let them know that I had contacted them and that my payment would still be a few days late. I continued to get harassing calls. They began calling my mother and explaing the details of the loan and late payment. I finally asked that they stop calling her and at least they seem to have honored that request.

They received the payment approximately 20 days late. I have since been late now on my May 20 payment (it was sent about 15 days late). They have been calling but I have been receiving voicemails from someone called 'Stacy' saying that I better call back immediately and that I 'better have a better attitude this time'?! I called back after getting this message (yesterday) and got someone else who was plesant and she noted my account that the payment has been sent and should arrive soon.

Today I get another call from 'Stacy' and she leaves a message saying 'you need to call me immediately - I see what you did yesterday and it's not going to fly - you need to call me immedaitely. I know you are doing everything to avoid working with us, but you need to call TODAY!'

I immediately call and get Stacy. She begins to tell me that they cannot take late payments through the mail and that I need to pay by check over the phone for an added fee. I tell her that the check has already been sent and then she goes on to state that they won't accept the check and I had better put a stop payment on it. She then goes on to state that I am living in THEIR house and if I want to continue living in it I had better pay by her method. After some argument she puts me on with a 'supervisor'. I calmly explain to him that the payment is in the mail, that I have tried to work with them about this and that the last payment was my last late payment as I had finally got things caught up.

He then starts to badger me about my next payment stating that it is a higher ammount (he rattles off some numbers) and asks if I am going to pay that ammount with the next payment. I state to him that I will be paying the billed ammount. Then he again asks if I am going to pay 'XXXX' dollars (the higher ammount) - so I again state that I am going to pay the amount due when it is due. So he goes back and forth asking if I am going to pay the higher amount and it just goes down hill from there. I finally ask for his supervisor and he refuses so I tell him that I am hanging up if he can't put me in touch with a supervisor - he says 'you better not hang up on me' so I do.

My major complaint is that they seem to be wanting me to pay with a check by phone that has some high fees associated with it. Then the supervisor tries to get me to agree to some higher amount of payment. It all seems shady to me. Yes I am a few days late on two payments (with the previous 6 years on time). But I have worked in good faith to let them know in advance. The loan is not even in my name and it's of no consequence to my credit report if they get paid at all, but I wanted to do what I thought was the honest thing and they try and rip me off in response.
