Spouse was contacted at work. Spouse requested Franklin Collection Services to call residence to speak to me.
That night, the mail was opened from Franklin Collection Services. It was 9:00 P.M. I told spouse I would call them in the morning. He replied they were suppose to call you (home) today.
I immediately called the number on the computer printout sent. The young female said my spouse refused to make a payment over the phone and our case had been turned over to attorneys.
I replied, "No ma'am, he requested you call his residence to speak to me". She then said she could stop it from reaching the attorneys office. She did let me know in the morning would have been too late to call. She also claimed to avoid $600 in attorneys fees and the court costs a interest payment must be made over the phone that night.
1. The printout gave ten days to reply. It was postmarked on day eight. Received on day ten.
2. Attorneys fees cannot exceed one-third (33%) of amount of debt. The number she gave (to frighten me, in my opinion) was two-thirds (60%) the amount of debt.
