My daughter's vehicle was backed into in a parking lot by an Allstate insured who admittedly was on the phone and not paying attention. When it came to Allstate paying for the damage to my daughter's vehicle, Allstate claimed that it found my daughter 10% responsible for the accident because she never hit the horn to warn their insured.
Therefore Allstate decided that it would only pay 90% of the claim and that my daughter would be responsible for the remainder. I tried to argue the point with Allstate, but they would not move on it. She could either accept the 90% or fight it in court, which would have cost more than the 10%.
All of the insurance people I explained this to had never heard of such a thing, but they were not surprised to hear that it was Allstate that had done this.
