I purchased a mobile home from Malcolm Hiett, owner of Yosemite Terrace Mobile Home Park and the adjacent Yosemite Westlake Campground / RV Park with the mortgage being personally financed by Mr. Hiett in late March. As a retired law enforcement officer and experienced property manager, fluent in CMHRL regulations, I was hired to manage the Yosemite Terrace Mobile Home Park property in June where Mr Hiett personally owns more than half of the homes that he rents out to unsuspecting tenants, and has sold numerous homes in the mobile home park where he personally carries the notes.

Both of his maintenance men work unlawfully as 'independent contractors' as they do not meet the legal California requirements for this classification, and Mr Hiett carries the notes on the mobile homes he has sold to both of them, and others without possessing legal title or ownership, and fails to meet his legal requirements to transfer registration / ownership within the legal time frames. He also rents out numerous mobile homes in violation of CMHRL regulations that do not meet California minimum habitability laws. Yosemite Terrace Estates MHP is a designated (senior) 55 age restricted park but fails to meet the age requirements to rent homes Mr Hiett personally owns.

Mr Hiett has changed the ownership of his properties to a Nevada based LLC to protect his liabilities, but does not register his personally owned rental homes as part of the LLC property.in managing his RV Park / Campground, Mr Hiett, Mr Hiett unlawfully uses so called 'independent contractors' to provide maintenance services, both of which are of questionable moral character as one is a registered sex offender and the other is a convicted felon... Thief and drug addict.

During the time I worked as Manager I injured myself on 3 occasions by falling through the rotten steps to the residence provided to me for my position, and also fell off a step ladder provided for several weeks after the entry porch to the office was removed. Each and every injury was reported and Mr Hiett failed his legal responsibility to provide DWC-1 injury forms as he did not carry legally required workers compensation insurance. After I pressed the issue and complained in writing, I was soon suspended from my position as Manager of Yosemite Terrace Mobile Home Park.

The same day of the suspension a Complaint of Retaliation and Employment Discrimination was filed with the State of California Labor Board, which offered me numerous protections from unlawful termination and other protections for filing complaints with State Agencies; as well as numerous complaints with Mariposa County and other State Agencies. When Mr Hiett failed to pay me for several months of work, a wage claim was filed and I was subsequently unlawfully terminated without cause and evicted from my residence supplied for my position.

In addition, I discovered that the mobile home I had purchased from Mr Hiett had never been legally transferred to its location in Yosemite Terrace Mobile Home Park and was registered in another county. When I listed it for sale, Mr Hiett, who holds a PhD from University of Southern California, delayed the sale for 5-6 months because of his failure to transfer registration and ownership interest to me. Because Mr Hiett failed to transfer registration and ownership interest in this home, I was unable to file tax returns for 2010 and 2011 as Mr Hiett refused to supply me with mortgage interest payment information because he tries to run the income received from his personally owned properties through his LLC to avoid paying taxes.

Additionally, his failure to transfer registration and ownership interest in the home I purchased from him caused me to lose my ability to take advantage of the one time Federal Re Investment and Recovery Act tax benefit costing me the $5,000 tax benefit as I could not provide proof of ownership interest. During the time I was suspended from my position as Manager, Mr Hiett and his maintenance employees unlawfully entered my residence without permission or legal written notice and stole business and personal files as well as bankcards and checks, and also stole my locking mailbox and replaced it with one that he had a key to, enabling him to enter my personal mailbox and steal mail.

Numerous complaints were made to the Sheriff and Post Office and my wage complaint hearing was successful in winning a judgement against Mr Hiett and Yosemite Terrace Estates, MHP. The Retaliation Complaint filed with the state sat dormant for nearly a year but is currently being investigated. Mr Hiett once told me that the residents in his mobile home park were an accumulation of idiots and he has no respect for them or for following his legal obligations to manage his businesses under California laws and regulations. He still does not carry legally required workers compensation insurance and fails to meet other labor laws.

He does not report the barter / trade / labor earnings to his so called 'independent contractor' employees and I'm wondering if many families with children or other people would patronize his RV Park Campground if they knew his maintenance employees were convicted felons and registered sex offenders. A complaint has also been filed with the California Franchise Tax Board regarding his fraudulent activities as well as the California Department of Housing and Community Development and the Departments of Fair Employment and Housing and CALOSHA, as well as the Department of Labor and Industrial Relations. Hopefully the Franchise Tax Board and the IRS will investigate his tax fraud activities and the numerous State Agencies that have been contacted will catch up with him sooner or later. BEWARE OF MR MALCOLM HIETT AND PLEASE CONSIDER NOT PATRONIZING MR HIETT'S BUSINESSES.

His wife, Heidi Hiett is also an owner and knowing conspirator of the illegal and immoral activities. Mr and Mrs Hiett want people to think that they are good Christian church going people above reproach but in reality are as scandalous and crooked as they come with their only interests being able to line their pockets at others expense and getting over on as many people as they can. Mr Hiett has also tried to obtain a retraining order against me but has failed, claiming he was scared of me because I have the legal authority to carry a concealed weapon in California and have been involved in several shooting incidents in the line of duty before being honorably retired by the State of California. He is nothing short of a scam artist that thinks he can outsmart everybody because he holds a PhD.
