Orbitz, LLC, is a dishonest on-line merchant. Orbitz owes me $1,600 under its own terms and conditions. The company refuses to pay me compensation to correct the effects of the fraud it perpetrated against me in 2005.interestingly, Orbitz does not dispute anything in the numerous complaints that I have filed through third parties in order to try to shed some light of day on Orbitz's deceptive business practices and failure to deliver. Without addressing the plain and unambiguous meaning of the transaction terms and conditions which Orbitz, LLC, itself drafted, Orbitz continues to deny compensation to me.
Undisputed Facts:
In March I purchased airline tickets from Orbitz, LLC for $4,959.95, for travel in June. I provided my credit card information solely to Orbitz; Orbitz charged me a fee; and Orbitz shipped the airline tickets from its office in Mankato, Minnesota.
Orbitz, LLC, terms and conditions state: Changes to this ticket will incur change fees.
I did not initiate changes they were not voluntary to me. Orbitz acknowledged in writing that changes in schedule were significant in extent and a multitude in number.
Changes did require reissuances of tickets, and at my expense (although Orbitz has in writing to third parties implied that tickets did not need to be reissued, and this is false and intended to deceive.
Orbitz abandoned my family without a flight from New York to Chicago, after promising by phone and e-mail to find us a new flight after one of the three airlines involved in the trip made a change that made a connection impossible. After making promises and dragging its feet for weeks, Orbitz just hid out and waited for us to disappear.
Orbitz did not pay me any change fees. I have made repeated written requests to Orbitz, its former parent company Cendant Corporation, its current parent company Travelport, Inc., Travelport's parent company TDS Investor (Bermuda) Ltd, and TDS's ultimate controlling entity The Blackstone Group.
Concise Summary of Dispute:
I say that Orbitz has engaged in fraud, misrepresentation, deceptive business practices, breach of contract, and failure to deliver. What else could I conclude? Orbitz has said that this is good business, and sends information about lost baggage and the Warsaw Convention. I never said anything about lost baggage. I say that Orbitz owes me for changes in schedule: $1,600 equals $80 per change, times five changes, times four ticketed passengers.
Orbitz Stranger to the Truth:
Orbitz has consistently lied to me and to third parties through whom I have sought assistance in this matter. They have made gross distortions, implied half-truths, and outright falsehoods.
Orbitz, LLC, pervasively is managed as a thoroughly dishonest and deceptive enterprise: rotten to its core and without shame. Blackstone Group CEO Stephen Schwarzman condones this behavior, as does Travelport CEO Jeff Clark, as does Orbitz Worldwide President Steve Barnhart, as do a cast of dozens at Orbitz. I must offer the name of Orbitz Director of Customer Relations Stephen Sedlak, and by first name Orbitz's Stan, Jennifer, Neal, Venessa, and Cody. Henry Silverman, CEO of Cendant Corporation and one of the most lavishly compensated CEOs in history, had no objection to the lies of Orbitz's Stephen Sedlak or of Cendant's Jeffrey Moss.
Alas, Cendant Corporation eventually tired of all these deceptions and sold-off its travel division, including Orbitz to a fund organized by private equity equity giant The Blackstone Group.
Conclusion:
Shakespeare wrote: No legacy is so rich as honesty. Consumer complaints represents an honest and independent vehicle for shining some daylight on Orbitz's fraud and falsehood. For that I thank you.
