My husband and I impulsively purchased a timeshare through Westgate Resorts on August 13. Within 24 hours, we made the decision to cancel the transaction. Less than 48 hrs later, with signed Request for Cancellation on August 15, I appeared at the Houston, Texas area sales office. The sales floor was closed at the time so I proceeded to the administrative office in the building. I was immediately greeted by on office worker and I emplained the reason for my visit. I was told by the young lady that she could not accept my Request for Cancellation, and that I needed to return in 2 days when the sales office would be open. She also informed me that I had at least 7 days to cancel, contrary to what I had been told my the closing agent. The recission period was not initially addressed during the signing of the closing documents, so we asked and were told that we had 10 days in which to rescind. I inturn asked her if I could fax in my request due to time restraints. She told me that I could not, I needed to handle it through the closing agent. I appeared once again on August 17 and met with the closing agent and was told that I was mistaken by a 5 day recission period and not 10.
First it was 10, then it was 7, now we were down to 5 days which was it. I was also told by the closing agent that they again could not accept our request for cancellation but that we needed to forward it to their Corporate Headquarters.in our opinion, this tactic was to ensure that it would not be in receipt by the recission deadline. The request was ultimately sent by UPS on the following business day which was August 18. I later received a letter stating that my letter on intent to cancel had been received, but it was received after the recission period had expired. We have gotten numerous calls and letters addressing our timeshare dues and fees due. We are at a loss as to where to go for help. We have made a number of calls to try to resolve the issue, but to no avail.
