We were (my wife and I) in Branson, Missourri, with our friends, last December 9. On December 10, we were invited to listen at 9am about Spinnaker Resorts. We were waiting for our names to be called in the receiving area for the guests. The agent which was Cindy Jones-Taylor was the one who was in assigned to us. We were 5 in the table, two of us and our 2 friends. Cindy was talking about owning the Spinnaker Resorts, the advantages, toured & showed us the unit and so on. We told Cindy that we already have 2 timeshares. But she was still eager to ask if we want to own one in Spinnaker, we said if we can find a buyer with one of our timeshares, then it will be alright. Cindy asked the help of Jim Darrough (the Resort Sales Agent). They brought the matter to their Manager which is Rich Coppett. Jim Darrough & Rich Coppett assured, that for sure they can have someone sell our timeshare in Fairways & Bluewaters in the Philippines. They recommended Leonard D' Elia, President of VAIC Company & an International Sales Manager. Jim & Rich said D' Elia will be incharged for resales and rents of our timeshares. Jim Darrough & Rich Coppett contacted Leonard D' Elia. They were the ones who talked to D' Elia first and handed in the phone to us. D' Elia assured and gave his go signal that we can buy the Spinnaker Resorts right away. It's because he will take care selling our timeshare in Fairways and also the rent of our other timeshare in Florida. We asked what will be our assurance if he can't sell it otherwise we will end up owning 3 timeshares if the transaction will not go through. D' Elia said if he can't be able to sell it in 3 months, then his Company which is VAIC (Vacation Anywhere International Corporation) is going to buy it. If it is all possible to retrieve this phone conversation to the Telephone Company this will prove what Leonard D' Elia has really said. We have agreed and purchased the timeshare in Spinnaker Resort in Branson, MO last December 10 provided that the Company (VAIC) care off Leonard D'Elia is going to sell our timeshare in Fairways & Bluewaters in Boracay, Philippines. The sales agents (Rich, Jim & Cindy) knew this conversation. We kept on asking the agents if Leonard can fax to us the papers as per conversation for our records. Meaning, that he's going to sell it within 3 months that if there will be no buyer, the Company/VAIC is going to buy it. Our friends were insisting about that verbal agreement that we had with Mr. D' Elia to put it in writing. Rich and Jim said we need not worry for they are going to provide a fax after signing of contracts, however later the agents said they are going to give the papers before we leave Branson, Misourri on Dec. 11. And later again, they changed their mind and told us that we can receive the papers by mail thru USPS by Tuesday early in the morning (December 13). Knowing they will do all the matters, we bought the timeshare in good faith, we were asked to pay the 10% downpayment of $1,820.00 with a check. After those promises, we were brought to Marsha Guthrie, the verification officers for signing of the contract.

We waited for the papers but it didn't reached on time as what they said. December 14, we called up Leonard and he said he already asked Robbins, his assistant to mail it to us. When we called up Robbins, she never recognized and was unaware of the transaction. Then we called up Leonard again and he said, that he can't be able to send the papers without the payment/agent's fee. We told him that he has not mentioned any fee to be paid when we talked over the phone in Branson, MO. However, he insisted that we should pay him $530.00. We were finally forced to pay him thru our Debit Card (Master Card) dated Dec. 15 on the condition that he writes down in the contract that he will buy it in case it didn't sell in 90 days. He agreed and promised to comply and to send the contract to us immediately. After 3 days we received the papers, and what we agreed was not written in the contract. So, we called up Leonard D' Elia again but he said that he never promised to buy it if it doesn't get sold in 90 days. It is a fraud knowing that we had 2 other witnesses in that transaction in addition to Rich Coppett, Jim Darrough, and Cindy Jones-Taylor. Leonard continued denying what he has promised to do. We are very disappointed with this unscrupolous transaction.

We sent letters via certified mail with return cards to Rich Coppett, Jim Darrough Cindy Jones-Taylor and Marsha Guthrie last January 10 disputing the account but to no avail. We already got a Legal Counsel with regards to this matter and wrote them a demand letter. We even called them many times and left messages but they were not responding. So, we decided to brought this matter to higher officials via certified mails, to Kenneth Taylor (owner and President of Spinnaker Resorts) and Teri Lett (overall Sales Manager Branson, MO) February 10 to cancel the purchase of the time sharing and requesting them to return the deposit $1820.00 immediately. But until now we didn't receive any reply from them.
