RE: Account Number I am writing in reference to the above account on telephones: XXX-XXX-XXXX and XXX-XXX-XXXX. I am requesting a copy of the contract for that service and an itemized bill reflecting the period of time 04/14 06/14 to include the termination bill that resulted in the final billing amount transferred to Collection Company of America, PO Box 329, Norwell, MA 02061-0329. Please include an itemized billing log and all roaming charges applied to each individual call.

I requested this service via the Customer Service phone feature and it was not made available to me, hence I have no understanding of the contractual agreement.
After attempting to work out an understanding of your roaming fees through the direct Customer Service feature with Cingular to no avail, I went out to the point of purchase to discuss the billing issue with the same representative that I signed the contract with. XXX, at the XXX Mall office in XXX, New York had no working knowledge of the billing practices and was unable to contact billing or Customer Service from that office. It was stated: the phone numbers must have been changed for their direct lines.

I then sent a registered letter (Article Number 7003 2260 0007 6162 9557), stamped signature XXXXXXXXXXX, received 05/17 at the office location: Cingular Wireless, PO Box 17496, Baltimore, MD 21297-1496. This letter updated my new address, as I was forced to move for financial reasons as well as unforeseen domestic problems. It further requested termination of the contract as a final bill with a total figure would be far more manageable than what was coming at me with your active phone service.

I made two payments within my budget, and although both cleared my bank account I only have a statement reflecting that on was received. Check number 912 for $10.00 is still in question. Before you respond as though that is a pittance, I hope you accept that you a major corporation that have gone to extreme lengths to secure a sum that is measurably of equal or lesser value to a company of your net worth. I can appreciate that you could not possibly give each customer leniency or grace in a utility during a time of financial difficulty, you would go bankrupt yourselves.

However, this service does not perform as a utility at all and is highly suspect in the mind of the consumer s well as the FCC. I believe the contractual obligation is written as such because cellular phones are nothing more than glorified baby monitors or walkie talkies that are subject to even more service interruption than the archaic phone lines that connect to Long Island, NY. I have personally watched a storm create a satellite interruption lasting over an hour and can just imagine the tower transfer fees from air to ground and ground to ground that are being defrayed to the unknowing customer.

As far as your collection agency of choice and the phone call of last evening, 07/28/04. I am looking at the Attorney General's Tips For Consumer, and I think the collection agency should go over some of that fine print with their collectors. It seemed funny that his supervisor had to break in and excuse him from the call stating: I am sorry XXXX has a meeting. Can you imagine forgetting you have a meeting? I could not either so I looked into it.

I am not angry, and frankly, if I worked on commission like debt collectors I definitely would take a different approach. You catch more flies with honey than you do with vinegar but when that does not get a quick verbal recorded agreement, try a nasty tone of voice and financial reputation, advertisement of debt and possibly misrepresenting the amount of the debt. He was so close to working it out too, until he just went crackers on me. I am a good faith, hand shake character who'd give you the shirt off my back and my blood if it came to it. I am not rich. I just left my former home and relocated reporting a child abuse incident, knowing full well it meant financial ruin and homelessness for myself and my daughter. I know I did not sign a good faith contract. Those people on the phone with their 33% interest and $1,500.00 fine, honestly!!!

Now I am upset. All I can say is, I hope we can work this out without having to make matters worse. It seems there is enough to deal without stress related illness and job loss due to missed quotas. I can be contacted by mail and wish you to do so with and in accordance with FCC Form 475:8974997.
