Jay Fabrikant presented himself as an attorney representing a client who wanted to purchase my timeshare in Maui. (My timeshare was advertised on the web with only an e-mail address for contact.) Per Mr. Fabrikant, his client's, Jack and Lindsy Meyers, saw the ad and contacted Mr. Fabrikant to process the sale. Mr. Fabrciant was given a certified Wells Fargo check in my name for $35,500 and drafted the contract. The 32 page contract was delivered to the U.S. Notary Service for verification of signatures.
The U.S. Notary Service called my home to inform me that they were holding a 32 page contract and a $35,000 check in my name pending delivery. They stated that the contract and check was related to the sale of my Maui timeshare. However, they could not deliver the contract and check without the authorization of the attorney on the contract. The U.S. Notary Service agent gave me the telephone number of the attorney, Jay Fabrikant, (772) 501-0300.
Jay Fabrikant confirmed that he received a certified Wells Fargo check for $35,400 and initiated a 32 page sales contract. Although the payment reflected double my asking price, Fabrikant had no idea why the Meyers certified the check for $35,400. Per standard pratice at the Fabrikant firm, the contract and check were sent to the U.S. Notary Service for verification of ownership signatures. Jay Fabrikant stated that I needed to wire $398.00 to his Notary, Clifford Givens in Palm Beach, Florida. This fee would pay for title and notary costs associated with the verification process. He requested that I call Mr. Givens @ 407-545-1529 with the Western Union authoriization transaction code when the money was wired. Mr. Givens was graciuos enough to spell his name two times and have me repeat the spelling, so as not to cause delay in the delivery of my money.
