An agreement to pay 50% down, and 50% upon completion was deliberately breached by owners, Mark and Sally Korth dba Mark's Custom Woodworking, when they refused to deliver remaining materials and complete remaining work, demanding a progress payment. Later, they sued for the entire value of agreed contract including undelivered materials and unperformed services.
A partcial judgement was awarded, and entered forcing payment. Project remains incomplete and we must bid out remaining work.
