Incompetent, lazy, and unresponsive mis-management company screwed-up my auto debit then filed suit

Caruso Management is the management company for the homeowners association, of which I am a member. I own a long-time townhome in the community, which I lease out to a family (the association has a copy of my lease).in March of according to Caruso's instructions, I provided Caruso my auto-debit information in their "census" form. Please note that I had had auto debit without any difficulty for the approximately eight years preceding with the previous management company.

In the months following March, I was in Caruso Management was in contact with me, back and forth, via emails on other topics.in addition to my email, Caruso had my phone number, which they later confirmed (and even my Facebook information, as I am on the homeowners association's Facebook page). The president and secretary of the association also have my email contact information. Also, in addition to all these contact methods, Caruso could have simply had someone knock on my tenants' door.

Instead, in September of this year, Caruso through their attorneys Keay and Costello, filed suit for of all things unpaid HOA dues, and had a sheriff deliver a court summons to my tenants (as "unknown occupants"). It turns out that the buffoons at Caruso had never processed my auto debit information for the monthly HOA assessments, claiming evidently that they had not received the information, even though they'd deposited the March HOA dues check which I had also directly mailed to them.

So rather than contacting me on this issue (while contacting me on others), they waited for months and filed suit instead. When I learned of their failure, I sent payment for the full HOA dues due (plus thru the following month). Nonetheless, despite all evidence to the contrary Caruso refused to drop the suit.in the end, because I currently live in another state, I was forced to pay all of the penalty fees, legal fees, and court costs, $774 in total, in order to have the suit dismissed - in effect having to pay for Caruso's incompetence, arrogance, and inaction.
