Keith Osterholt Paid for leads $2,700.00 not provided - refuses to refund money

On May 23 Our company purchaced $2,700.00 worth of leads from Keith Osterholt at Jacoby Sax, LLC. Services were supposed to start within a week...
Two weeks passed and no leads. We contacted Keith and he apologized for the delay and promised the leads to be sent in 2 -3 days.
Another two weeks passed and no leads.
Keith Osterholt was contacted by our firm and he explained he did not have the leads and could not provide a refund. He "claims" an employee stole the leads and sold them to another company.
We have hired a collection firm to recover the monies stolen from our company at this point, now Jacoby Sax is claiming they might have to file for bankruptcy.
There has been no police report filed againt anyone by Mr. Osterholt or Jacoby Sax.
This is a guy with a web site and some marketing skills that rips companies off. He wont provide leads nor a refund.
