Team Failed to up hold the Duties of a Real Estate Licensee, and made unauthorized transactions for the Seller Las Vegas

Rick Brenkus and his team ripped ME off.

Rick Brenkus (16186) - Justin Zagar (39931) - Robin Silverstein (39931).

Rick Brenkus came to seller's home and made seller believe he wanted her to become a real estate agent for him, once the home sold. Therefore, butter up the contract or keep seller off tract.

Rick told seller the house would not sell at her asking price and just plain told the seller what it would seller for and if no one offered in two weeks, it would come down even more.

The house now listed for the second time on the MLS, the agents and buyers poured in. No other marketing performed on Rick's behalf.

The seller acted as AGENT, whom showed the house and got five offers for full asking price in one day.

Seller accepted an offer of 1,000.00 more than asking price offer to close on 7/14/03. Buyers waived home warranty and inspections; and personally told seller not to make any repairs or paint any further.

The deal was to close on the 14 of July and seller had 24 hours to vacate property or pay the most the law would allow in rent to the buyers.

Justin arranged with seller to pick up the check on 7/15/03 to assist seller with quick move out. The Brenkus team ignored the closing date and allowed extensions to the buyer without penalty or notice to seller.

Once questioned on the issue, Robin blamed Justin and Justin acted as if he never even read the offer.

The buyers and the Brenkus team refused and then unwillingly released some escrow money in good faith to help seller.

The neglect left the seller and two small girls struggling for a place to live and therefore, experiencing unnecessary trauma.

The Brenkus team continually made decisions without consulting the seller or bothering to follow seller's instruction.

After finding out about one more request for an extension, approved without authorization, the seller instructed Justin take the home off the market, per contract the seller wanted to rent it out with a different agent.
Buyers placed the blame on the lender; The MLS (given to seller by close friend and agent) had an estimated closing date as 7/31/03. This leads seller to believe The Team knew this and tried to hide it. That is customer Service for ya!

The next day, Robin pushed the deal through and buyers signed and closed.

During the transaction, the Buyers wanted to buy the Frig and w/d. Seller refused purchase. On the day of closing of 7/24/03, Buyers told landscaper employed by Seller to fix a leak by the pool, which they had turned off the water to the house, because of a small leak. To be released at closing

On the day it recorded, it turned into a 1,000.00 damage done to the wall due to the refrigerator and w/d not capped.

The team failed to provide notice of any second request to repair, causing escrow to withhold the money from the proceeds. Buyers are requesting seller to release the funds to them to pay for the wall.

In the closing papers, Keller tried to charge seller for representing the seller and buyer. The buyers already had their own agent. Rick did not even come back to seller's house for any reason. No one from his team came to the seller's house.

Keller charged for over 7 thousand in commissions to seller, and did not do anything to the benefit the seller. Agent caused undue stress and expense to the seller. Agent still causes stress and expense to the seller today.

One last thing discovered. The broker for the agents was Gail Fox Brown and at that time held the seat of the Local Board of Realtors. Gail refused to investigate the issue for the seller.

In opinion of the seller, this is a big conflict of interest. So be warned if you use these people. Save your money and sanity, sell your house yourself.

Due to the negligence of Rick Brenkus Team and Keller Williams Reality the Marketplace, the buyers are suing the seller for 2200.00.
