My Sharp 52 LCD HDMI TV was damaged as a result of the Budget Express Moving & Storage breached our contract stating that they were going to specially wrap and crate my four flat screen TVs and glass TV stand. Because the items were not crated there was no protection for them. The purpose of crating the TVs was affording the TVs the protection it needed to be able to be moved without damage. The TV in question had a large crack on the screen and got significantly bigger after turning on the TV until the TV just did not power up again.
Company only offered me 60 cents per pound as stated on the contract for liability. They did offer $100.00 but the TV cost me $2400.00 one year ago. I told them that I could get an exact one for $1400.00 at Sam's Club but they refused. They said that they had wrapped the TVs with bubble wrap, cardboard with tape and moving blankets and that constituted a crate. A crate is usually a wooden box built around the item being packed or covered which separate from the wrapping. And that is what they told me when they gave me an estimate and that is what I relied upon. Then they said that I helped wrap the TVs and I should have known. But when I told them I was not even there when they wrapped the TVs they said that the crate they had made was sheathed or unsheathed.
Even with a threat of a civil suit, they are not budging. They will not negotiate or at least make good on their liability of a complete refund when the did not crate the TV as stated in our contract.
