Loan modification fraud and false advertisement on no upfront-fee violated SB94

A real state program from a radio station referred us to call Flahive Law Corporation to assist us on our loan modification and the radio station told us that there is no up-front fee to see the firm. I called Flahive sometime in February and talked to a person named Greg and did interview me regarding the loan modification with our lenders. Greg said that I am qualified for the loan modification and have a case to precede the loan modification service. On February 9, our first appointment with them, we met with Ursula Walker, a paralegal supervisor for Flahive Law Corporation. That day, Ms Walker confirmed to us that we were also good candidates to precede the loan modification service with our lenders and she asked us to write a check for the amount of $2,490.00, which is the first stage of the loan modification service. My husband and I were surprised that she asked to pay right away prior to service but with the referral from a radio station and being so desperate to save our home we decide to go ahead and pay them the up-front fee although their previous ads stated that there is zero fee (I kept copies of their previous ads stating the zero upfront fees). The same day, Ms. Walker also stated that we should file bankruptcy because according to her, it will help our loan modification case with our lenders. Of course, with our desperation to save our home, we wrote them another check for the amount of $1,444.00 for them to do our bankruptcy. I tried to check with them frequently by phone but it is too hard to get a hold of them and if I get a hold of them it will be a customer service that will answer the phones. Months later, Ms. Walker informed me that the loan modification process will be on hold because our bankruptcy has to be discharge first before they loan modification department can proceed with it. I told Ms. Walker that why did she collect the up-front fee of $2,490.00 dollars for the loan modification when the bankruptcy will take at least 6 months to be discharge and she does not an answer for my question. On June my husband finally went to their office because we wanted answers from them regarding our loan modification and very worried by missing 3 months mortgage payments already. When we went there, Ms. Walker refused to see us because we did not have an appointment with her. My husband and I told the receptionist that did not make the appointment because she seldom returns our calls that are why we are here to talk to her. To make the story short, we asked the receptionist to tell Ms. Walker that we will wait for her until she is ready to talk to us 30 minutes later, Ms. Walker storming out of her office with her exercise arm band and yelled at us saying 'you have 5 minutes, 5 minutes of my time!". We did not care how she felt about us that day and asked her if we could talk to a quiet room. To make the story short, during the meeting with her, she did not let us talk at all and basically told us to 'shut up' and let her do the talking. We could not believe how rude and disrespectful Ms. Walker to us that day and I just finally hold my husband hand, look at each other and we both said to Ms. Walker that we are withdrawing the service today and we would like to have our money back. I sent Flahive Law Corporation number of certified mails requesting a full refund of our $2,490.00 loan modification fee, the return of all our personal documents that we submitted to them and copies of all the documents that they send to our lenders since June 2 and until now no luck at all. A month ago, my good friend told me that she also hired Flahive and Ms. Walker told her the same thing that her loan was declined by her lenders. My friend went to their office in Folsom and asked Flahive to give her back all her personal documents she submitted months ago but Ms. Walker staff told her that she has to put it in writing before she can get her personal documents back from them. Ms. Walker staff sent her home empty handed. I am waiting for State Bar of Californias respond to my complaint and I heard from them that it will take months because of the many complaints regarding loan modification scams. For those of you that thinking of hiring a lawyer to do your loan modification, please do your homework first.
