My name is Synovia Dover-Harris and I am filing a complaint against Brian Scott Johnson and Brian Galloway at Data Processing Services / ROOF ROOF Replacement Specialist. I got a call on May 24th from a young lady saying that some homes in my area have had hail damage and that their company will be out it my neighborhood the next day and if it would be okay for them to come and inspect my roof. I am 7 months pregnant and was asleep, so when the lady called I basically told her yes (1st sign). The next day which was May 25th a young guy by the name of Brian Scott Johnson came to my house and stated that he had looked at my roof and it had hail damage. He then came into the house with a contract for me to sign. He BRIEFLY explained the contract and said to sign here (2nd sign). He had already filled in the contract and even had my name printed on it and all I had to do was sign my name. (3rd sign) For one thing I never read the contract and for two my husband was here who actually makes all the home improvement decisions. I am 7 months pregnant and have a 2 year old so obviously I was a perfect target.
Scott Johnson told me to call him before the adjuster came and he will come by while he is here. Well the adjuster called on Thursday and came by that Thursday or Friday and said he does not need Mr. Johnson to be here (4th sign) for him to do his job as a matter of fact he said I should always get three estimates before deciding on a roofer. My husband is at work all day so therefore he was not here. The adjuster called the following day and said I had been approved for a new roof and I needed to wait a while before doing anything or making any decisions.
Well three weeks went by and the lady from Data Processing Services / ROOF ROOF continued to call to see if I had received my adjusters statement for Mr. Johnson to come and go over with me. When I called the insurance company they said to NEVER go over an adjusters statement with a roofer. (5th sign) When it was all said and done and I asked Mr. Johnson which was a month later to come and give me an estimate and he said I have a contract with them and he does not have to provide me with an estimate. He said the contract states that whatever the insurance company approves me for that is what they will use. Mind you I had never read the contract and he knew it. When I spoke with the insurance company they informed me that it sounded like a scam and I just became a victim of it. I asked Mr. Johnson if I could cancel my contract and he said I only had 3 days to cancel which by the time the adjuster came and approved me the three days were already up.
As stated earlier I am 7 months pregnant and should not have been handling this anyway. I called my best friend who is actually a lawyer and she told me that if I was not properly informed about my right to cancel by Mr. Johnson or given a Notice of Cancellation that my contract would be voided. I contacted Mr. Johnson on Monday June 28th and asked why he did not inform me about the cancellation process and he said why would he do that he is a sales person and it is written on the contract. The contract also states that I should have received a Notice of Cancellation and I did not. I also asked Mr. Johnson why he did not inform me of receiving 3 estimates before choosing one and he said thats not his job. To me this sounds like his job is scamming homeowners. I have done a lot of research and this is definitely a scam, just one of the better covered scams that they are saying a perfectly legal.
My husband never signed or looked over the contract and his highly upset. He had just got home from work when Mr. Johnson came and technically I only signed the contract I never printed my name Mr. Johnson did, which my best friend also said is a violation.
Mr. Johnson refuses to give me an estimate and failed to inform me about my cancellation options as well as printed my name on the contract. When I called today June 29th and spoke with the owner of the company Brian Galloway he basically told me there isn't anything I could do because I am stuck in this contract. He said even though the contract said that they gave me a Notice of Cancellation and told me about my cancellation options and they did not, it's written on the bottom of contract and I should have read it.
He said if I choose not to get the roof done I owe them 30% of the adjusters statement, which by the way they keep trying to make me show them. I called the insurance company and they said he sounds like he owns my roof and will try to sue me if I choose not to get my roof done. I explained to the insurance company that I would rather send them the check back and not get it done period if it has to be like this. They told me to consult with a lawyer, in which I did and he is currently looking into this matter. The last thing Mr. Galloway said to me was just show us the adjusters statment and sign over the check and we'll get you squared away. That was the most disrespectful thing I heard thus far, because to me it sounds like he's saying get over it.
