Outlandish Ripoff Late Fees

I noticed a late fee on my May statement from Sears MasterCard and since I paid online, on the day it was due, I called in to have it reversed.

The first 'account mamager' I spoke to said refused, saying that I had had more than one late fee in the past 2 years. And Sears would not refund the late fee as it clearly states on the agreement you click on to make the online payment that it takes up to 5 BUSINESS days to credit your account, and if late, you will be charged a late fee.

I explained that I pay lots of my bills online and had never heard of paying a late fee for paying online, on or before the due date. After getting nowhere, I asked to speak to a supervisor. She refused this as well, but after a couple of requests, put me on hold for 20 minutes.

The next person I spoke to again stated that it clearly stated their policy on their website, and in the user agreement, sorry, nothing she could do. After a little bit, she put me on hold to put me in touch with someone at Sears.

While waiting, I logged in to their website and made another payment. I saw one mention of the 5 days to credit the account, nothing about possible late fees though. When I printed out the 'online payment conditions' (interestingly, this is opens up in a tiny 2 inch window, but prints out as two full pages of text) the only reference to late fees I could find was the following.

'If the electronic payment is returned unpaid' you MAY be charged a late fee. It again mentions that it may take up to 5 BUSINESS days to credit your account, but does not mention that if the date of account credit is past the due date, you are charged late fees!

This lady went so far as to accuse me of trying to scam Sears out of its late fee! She said that by paying online on the due date, I knew Sears would not have the money one the due date!

I asked her how it was different than dropping off a check at a Sears store on the due date, and Sears not able to cash the check for a few days? She said that this was totally different, I would have a RECIEPT.

She also mentioned that this had happened to me before, so obviously I knew about it. I was aware that I had had a late fee in February, but had thought that I had messed-up and paid past the due date. I did a double check, and found that I paid online on the 22nd, my due date was the 26th, and it was credited on the 28th.

I think that it is fradulent to fail to CLEARLY warn its customers that payments made online are subject to late fees! An HONEST company would let its customers know that if it is within 5 business days, they could avoid a late fee by paying in the store. Heck, they should have an online payment due date. Naw, that would cheat them out of their fees!

It's kinda sad. I grew up shopping at Sears. Buying my school clothes there, making my Christmas wishlist from the Sears catalog. I am going to cancel my MasterCard and never do business with anything associated with Sears again. Until my children have their own money, they will not shop there either. I will let anyone who listens know what a skumbag company Sears is!

Oh, and for the record, I am perfectly willing to abide by my agreements with honest companies. If I don't pay ontime, charge me the agreed late fee. That's fair.

Sears has the following on my account statement. "Manage your account online 24 hours a day at SearsCard.com Register today! It's fasr, convenient and FREE"

Guess there is 'free' and then there is 'FREE"
