I made my final payment on February 4 (I am on a fixed income) on a Kingsdown Calwell mattress and foundation. It was delivered on February 6. I noticed within 30 days that it seemed to be sagging. After about another 30 days I was convined it was definitely starting to sag. I went to the Retailer to file a complaint and was told there was an Arbitration process must go through. I filed the paperwork necessary to start that process and was told I'd be contacted within a week. I was led to believe I would recieve a phonecall.

After about another month of hearing nothing, I again went to the Retailer. Kyle, the salesman I'd been dealing with through-out the sale, phoned Somebody and afterward I'd be recieving a form in the mail.
The form showed up about two weeks later. The form was from Mattress Warehouse. It instructed me to measure the
impressions in the mattress by laying a broom across the HEAD and FOOT and then measure the depth with a ruler. Nowhere on the form did it even ASK about measurements across the CENTER of the mattress. I sent them the form, including a diagram I'd drawn which inclded measurements from various areas, including the center. After about 3 more weeks, I got a phonecall from the Arbitrator; he was "in the area"... Could he stop by to
"measure" the mattress. I said "Sure. "A kid, about 16-18 showed up in a souped up '80 /- Monte Carlo and wearing
a black Fedora... He looked like a drug dealer, but was otherwise very polite. He measured my mattress via tossing a string across the bed and then placing
a guage at various locations on the mattress. (see pic at www.mattressmarshals.com.

After about another 2 weeks I finally received a letter from Mattress Warehouse stating my mattress was found to be "without defects" Further, if I wanted to file another claim in 6 months it would cost me $50 to do so.in the meantime I am stuck with a mattressthat sags.

Lately I've encountered an Insider to Matress Warehouse. He told me they have DOZENS of claims, and that Simmons (the Manufacturer) ROUTINELY refuses to take back merchandise. Also, the system is skewed because IF
the mattess IS returned, the Salesman LOOSES his COMMISSION, which underscores the bottom line for both Mattress Warehouse AND the Salesman.
