In September of I was contacted/phone solicited by Ryan Lewis in Long Island, New York; he represented himself as associated with Attorney Daniel H. Fox from Aventura, Florida; an Attorney "specializing" in Mortgage Modifications. I was given thier website: www.MortgageModToday.com. It looked very professional.
I was told if I retained Mr. Fox, I could have my adjustable rate mortgage modified in 45 to 60 days to a fixed rate, saving me thousands over the term of the loan. I asked for this confirmed to me in writing. It was, by Mr. Lewis. I paid them a retainer of $1495.00, quite literally all the money I had at the time. I Fed-Ex'd bank statements, taxes, pay stubs, financials etc., everything they required to contact my lender.
After 3 months of no communication, but constant contact from me, they finally were able to get me a Forbearance Agreement, for a rediculous amount of money. Never mind that I had previously negotiated 2 other Forbearance Agreements, directly with my lender, and on my own. Mr. Fox needless to say, did nothing for me that I could not do myself.
Over the next several months, I got occasional cryptic one line e-mails saying they were working on it, yet my phone calls, e-mails, faxes and fed-ex's were never acknowledged.
Ultimately, in desperation to hang onto my home, I filed Chapter 13. I then got permission from my Trustee to continue to try and negotiate a loan modification. Since then, I have been lied to by his "Assistant" Nadia Jose, completely ignored and not responded to. Last month, I did a web search on Mr. Fox and his multitude of companies, I found a website called, and low and behold, dozens of Complaints about Mr. Fox and his unethical business practices, and literally everyone on there had the same story as myself.
I posted a complaint on the board on April 15th. Miraculously, at 6AM on April 16th, I got a call from his Assitant Nadia Jose, who miraculously had an offer from my lender, after 8 months, to a modification at an attractive fixed interest rate. Coincidental? I think not! At which point, I was then told Mr. Fox no longer wanted to work with me because I filed a Complaint online.in a panic, I apologised, requested my original complaint be removed from the website, and I then posted a Public Apology.
Fast forward, it is now 1 month later exactly; once again, cryptic one line e-mails, or NO communication or return of phone calls etc. Now I am back to dealing with my lender directly because Nadia and Daniel Fox e-mailed me forms to start the whole process over again, for the umteenth time.
I have now advised my lender directly, as well as this SHLOCK Attorney that he is no longer representing me in this matter.
I have spent the last 8 months literally spinning my wheels, trying desperately to hang on to my home, all the while this CROOK is doing the same thing to many many others all over the country.
I am posting this because I have vowed to go public via all means possible to WARN other desperate homeowners to steer clear of this CON MAN.
I am filing reports with the Florida Attorney General's Office, the Florida State Bar, the West Palm Beach (BBB) Better Business Bureau and any other media outlet that is available.
Yes, I was naive. Yes I was desperate. But no, I did NOT deserve to be conned out of $1495.00 dollars, neither did all of the people who are in the same boat on the website.
This crook and his co-horts are literally kicking people when they are down and STEALING thier last dimes.
Daniel Fox has other officers (supposedly) at his company, Art Clyde, Daniel Clarins, Mary something or other, Martha Navarro, Nadia Jose and god knows how many others. They are ALL in this together. So PLEASE beware of any solicitation from anyone calling from Long Island on this guys' behalf, especially if his name is Ryan Lewis.
