In February, I contracted with Cumberland Log Homes to build a home in the Talking Rock Creek Resort mountain community. Shortly thereafter, the log package purchased from Southland Log Homes was delivered to the TRCR parking lot behind the Community Center. The package was partially covered and left exposed to the elements until April 30 when it was then delivered to the home site. As of October 22, the only work completed on the home was the construction of the concrete block crawl-space and concrete block piers, which were poured to the wrong elevations.
As of Oct. 22, I paid CLH $12,000, plus 15% fee, to complete the 1st phase of the dry-in. This phase was to include stacking and securing logs up to the 2nd floor. However, no such progress had been made, despite having been paid for.
Since then, I wrote additional amounts of $16,611.72 to CLH for labor and materials. Then, on November 9, I wrote CLH an additional check for $9000.00 to cover completion of the 2nd phase of the dry-in. As of Jan. 21, the dry-in had not been completed.
I have paid subcontractors a total of $12,090 for work that should have been paid for by the prime contractor - CLH. During all of this time, the log package stayed outside and partially covered, exposed to the elements, resulting in many warped, twisted, mildewed and damaged logs. It was the responsibility of CLH to protect the package from the weather, but CLH was clearly negligent.
On January 21, I terminated the services of CLH and its owner, Mike Schmank, and hired my own subcontractors to complete construction of the home which was finally completed in November. Throughout my dealings with CLH, I had very little contact with, and very little response from, CLH, and no reimbursement of funds paid to CLH for work that was not completed, not even close to being completed.
