E agent lied to me about the plan he was selling me

This is sort of my last resort to my problem. About 3 months ago, I was in the mall with my sister. She had been talking to a man named Vahit at a T-mobile kiosk. When I met up with her, she told me he had a great deal on a cell phone plan. I hadn' had a cell phone in 3 weeks, and really didn't need another one.

Anyway, when I got to the kiosk, the guy asked me what reasons I wanted a cell phone. I told him the only reasons I wanted a phone were for unlimited text messaging and internet.

We talked about a cell phone plan that would give me 1000 anytime minutes, long distance and roaming, no night or weekends, but unlimited internet, and text messaging for $60 a month. He showed me 2 phones, first the Sidekick, and second the Blackberry. I didn't know the difference between the two, because I had never had either. So, I asked his manager which phone he suggested getting. He told me the blackberry, so I said okay, that's the one I want, and went to pay for it.
Keep in mind, the Sidekick and the Blackberry were exactly the same price. When I went to pay for the phone, he went over the plan with me. He showed me I was getting the 1000 minutes, the Blackberry package, etc
A month later when my cell phone bill came, it was $262. I called T-mobile and asked them why in the world it was so high. The lady told me it was because I had sent and received so many text messages. I told her there must be a mistake, because I had unlimited text messaging. She told me that the only add on I had was the Blackberry package.

The only plan that me and the guy (Vahit) at the Kiosk and I had talked about was the 1000 minutes a month, long distance and roaming, no nights and weekends, and unlimited internet and text messaging. That was the only plan we talked about while I decided which phone I wanted for probably 30 minutes, if not longer. That was it. So when he showed me the Blackberry package on his computer screen, I didn't even think that it would be possible for texting not to be included in that. It didn't even cross my mind. That was the ONLY plan we had discussed.

I didn't have time to say anything otherwise to the lady over the phone because I was in a hurry. Plus I figured I would need Vahit to fix it for me, so I told her to change it to just text messaging because I didn't want to get charged again for more people text messaging me.
I went back to the same kiosk to talk to him, but he was never there. I decided to just talked to one of the other employees. I told him the situation, he told me that the Blackberry doesn't come with text messaging included for $60. He said the Sidekick does though. The Sidekick and the Blackberry were the same price. I told the cell phone guy, if I had known that, I would have DEFINITELY gotten the sidekick instead, so I could have gotten the plan I was TOLD I was getting. He actually kind of laughed and said Yeah, he's forgetful sometimes Saying that he probably just forgot that the Blackberry didn't come with the texting. So I asked him, okay, can I just switch out my cell phone and get a Sidekick? And he told me No, it's been over 14 days since you got your phone. I told him I didn't even know I didn't have the plan he told me I was getting until AFTER I got my cell phone bill, a month later! And he had nothing to say, except that he was sorry. I asked him how much it would cost for me to get the Sidekick, and he told me $400! Who has that kind of money for a cell phone? So I got locked into a 2 year contract, that was based on fraud Is there anyway I can legally get out of this? (with out spending money on lawyers?)

I want the internet on my phone because I get lost an awful lot driving around. I hate being lost, and having GPS is so extremely helpful to me.

I had let the issue go for a long time. Un till I was out, and I got very lost again. I realized I've been paying for a cell phone that doesn't have what I was told I was going to get on it, and I was lost because of it. It just made me more angry that I didn't have the internet on my phone to find out where we were going. So I called, talked to a supervisor, and told her the same situation. She said the same as the others I understand how you feel, I'm very sorry, there's nothing I can do.

So I got home, and looked up a website with lots of complaints about T-mobile. I found a phone to get in touch with the people closest to the CEO. Of course, again, I told him my issue also, and got the exact same response. I asked him. How is it possible that because one of your agents told me what plan I was getting, and I assumed he was telling me the truth, that I'm stuck in a 2 year contract? And he actually told me that he was going to write in my file, that I used the word I was getting the right plan. What else would I have thought? We only talked about one plan the whole time I was at the Kiosk! I wasn't going to assume that the agent was lying to me, and setting me up with something different.

I'm desperate to get out of my contract with them. They have been a huge head ache for me. And for me to add the internet to my phone with them would cost me an extra $20 a month. With the way the econmy has been the last thing I need is an $80 cell phone bill.

The contract was based on fraud weather the agent just forgot that it was only the Sidekick that came with text messaging or not that wasn't the contract I signed.
