Misrepresentation, misleading, and false information given manhattan new york

I have been a boost mobile prepaid customer for close to 2 yrs. I had their $49.99 grandfather plan up until 3/15/08. My credit card on file has always had sufficient funds available on my reboost date so that I could keep this plan which they got rid of a year or so ago, but as long as you had money in your account or on your credit card, they allowed you to keep this plan. I called boost mobile on 3/8/08 to add a different credit card to my account and specifically asked the representative, if doing so would effect my $49.99 plan, he said no, then he put me on hold to ask someone more knowledgeable and came back to the line and again said no, it wouldn't effect my present plan.

A few days later, I called back to inquire about my plan and if they added my new card, they said yes and I asked if there was anything else I had to do and they said no, that my plan would still remain the same. I checked my account online and it was the same plan with the new credit card on file. I called early morning on the 15th of March to inquire on why my account had a restriction on it and I couldn't call, receive or use the walkie talkie, they transferred me to several different people who didn't have a clue and finally after several hours and speaking with different people, a boost rep told me to turn my phone off and wait a minute, then turn it back on and it should work.

I followed her instructions and my phone was working fine, until I looked online at my account and saw that they were charging me for calls which should be free under my plan, including walkie talkie time. I called back to boost mobile and spoke with yet another unexperienced rep whom I demanded to speak with a supervisor who was not very knowledgeable on how to correct this error, but filed some kind of report on my account and said he couldn't promise that I would have my old plan restored.

All and all, I was misled, misinformed and ripped off because boost mobile assured me over a year ago that as long as I had sufficient funds in my account, my plan would remain in effect. I had the funds and they scammed me about changing my credit card and not affecting my plan, so that the could charge me with unreasonable fees and their current unreasonable plan for $70.00 a month. I will not stop until this is resolved in my favor. Boost Mobile is a fraud case and this shouldn't be taken lightly. What may seem like something frivious to some is major to others.
