10/08/07 Debi Gandy of Protextile Solutions emailed in response to my ad looking for a manufacturer. I gave her my form response that I give everyone, here is my price per whole item and if you do not like the price, please do not bother emailing back

10/08/07 Debi Gandy of Protextile-Solutions replied with housing my items is no problem and to send the paid sample packet with pre-paid shipping back.

10/13/07 Debi Gandy of Protextile-Solutions emailed letting me know that sample package had arrived.

10/19/07 Debi Gandy of Protextile-Solutions emailed to let me know my sample was done and on its way.

10/26/07 The sample arrived and I emailed her letting her know it had come but it smelled like smoke and I could not have my items smelling like smoke.

Andrea,
Thank you and yes there will be NO smoke smell in your products any more, that was my fault, i brought it home to package it, and i smoke at my house. There is ABSOLUTLY no smokeing at the plant. Again i am sorry for the smoke smell it will never happen again.

10/26/07- I emailed Debi Gandy of Protextile-Solutions and let her know that I would like to get started with her company. She agreed and I sent my fabrics, threads, patterns, sample bikinis, and a check for the full amount.

11/05/07- Debi Gandy of Protextile-Solutions cashed the check but no items had been sent.

11/06/07 I emailed her asking if everything was ok. She stated that it was that she had a flood in her warehouse my items were fine and that she was moving to a new place.

11/26/07 No package arrived.

11/27/07 I emailed Debi Gandy of Protextile-Solutions asking for the tracking number for my items. No email every came back.
11/28/07 I emailed Debi Gandy of Protextile-Solutions again telling her that communication was key and that we needed to find a better way of communicating.

11/29/07 11:39am Called and was told by her daughter that the items were sent and that her mother, Debi Gandy of Protextile-Solutions, was in a meeting and the daughter hung up on me while I was in mid-sentence.
11/29/07 11:41am Called back and spoke with daughter once again who could not provide the tracking number for me nor reach her parents for me to speak with.

11/30/07 9:22am Called. No answer.
11/30/07 10:08 Called and spoke with Bob Gandy who then told me that they could not do the work and would be sending my items back. I asked about the 3 checks and he stated he would send it back as well. He said she would give me a tracking number in email because it had already been sent out.
11/30/07 11:09am Called No answer.
11/30/07 11:44am Called No answer.

No tracking number provided.

Items finally arrived. All smelled like smoke. One check came back but the other two they cashed never arrived.
They are blaming DHL for the smoke smell saying that DHL has admitted to smoking in the trucks.

Here is Debi Gandy of Protextile-Solutions direct BBB response to my complaint:
when andrea contacted me via e-mail i informed her i would try to complete the order for her. When i informed her that there was to many difficulties useing industrial machines tomake the bikini's she got irate, I did make a total of 10 of the 25 bikinis ordered and returned the remaneing already cut and ready to be sewn. I am NOT responsible for shipping damages after it leaves my building. The DHL driver has addmitted to the damages and smoke. I personally never agreed to the $1 charge for cutting and pattern makeing time. Which added up to over 4 hrs of work. We could not manufacture the bikinis due to the material issues. I have customers who have been to the company and have seen that there is NO smoking in the building, and have also had complaints themselves about DHL. Due to the time in makeing patterns, cutting materials and the 10 bikinis that were made, there is a balance that Andrea owes our company. That is why no refund has been made as of yet. No company will charge or agree to charge 25 cents an hour for manufaturing. There was no signed non discloser or purchase order placed for the bikinis, nor a contract between my company and hers.

I spoke with Debi Gandy of Protextile-Solutions husband Bob after the items arrived. He stated he was sorry about the smoke smell and that I spoke with Debi Gandy of Protextile-Solutions wanted to be paid for the work done. I thought that was fair and he and I agreed to $1.00 per cut. Leaving a balance of $118 that needed to be returned. Bob Gandy of Protextile-Solutions said he would send a check.
He never did.

I had my attorney write her a letter. Debi Gandy of Protextile-Solutions, did not respond. I filed a lawsuit on 2/28/08 and Debi Gandy of Protextile-Solutions was served by the Lycoming Sheriff's Department on 3/3/08 at 2:25 pm.

I am asking for the $118 and the $61 for court costs. I have no gotten my attorney's bill yet but right now, I will settle for the $179.
I am taking the $1000 in fabrics as a loss on my taxes next year.
