Sticks it to me once again!

A couple of weeks ago i upgraded my cell phone with tmobile to the new sidekick id. I received my phone several days later and at that point changed my sim card to the new phone.

It took almost 2 whole days to get this phone activated (mind you all i did was upgrade my phone, not get new service) i actually had to call the tech line at tmobile to get it working. Well anyways the first few phone calls i made with my phone i noticed a high pitch sound in my ear, i did not call right away to tmobile, but i did call within a week of the phone being in my possesion to complain after the problem got a little worse it also started cutting in and out really bad (it was not the service either).

Well i went thru several phone calls to the tech support people who made me do a number of tactics to solve the issue and finally a lady told me to take it to a tmobile store and get a new sim card. Well with the nearest tmobile store being at least 45 minutes from my home i went that weekend for them to tell me it would cost like 20.00 for the new card and anouther 20.00 for them to tranfer my info to the new card.

Well i opted not to get the new sim card and tested it out on my old phone (a blackberry that i got last year) and the phone was crystal clear with no issues. So i called back and did a number of tech things once again until i was finally like look i want a new phone i have done everything you people have asked at least 2 times or more.

The lady on the phone read some vebage to me while setting me up to get the new phone and she got to part where she advised that it may be a used phone. At this point i advised that i would NOT accept a used phone as i just purchased a new one a that has not worked (2 weeks prior, this counts shipping and everything, so really i had only had the phone for about a week)
So she advised that she would put this in the notes.

Guess What!!! They sent me a used one. So i called and advised that i thought i had 14 days with this one and they said that becasue the replacement was ordered after the 14th day that i HAD to take the used one.

This is wrong. I paid for goods that was damaged and called to get it replaced and they sent me a used good in its place and refused to replace it with a brand new one (i paid for a new one and i want a new one) 1 week of using something that i had called on does not deserve a used replacement

Well the best part is that the used one does the same thing that the new one did. I want out of my contract... What is a person to do..
