Liars, untrustworthy did i mention liars? Ripoff

We recieved our quote from ERS. When we contacted ERS, we initially spoke with Leila. She was very helpful at first. We told her that we needed to have our house moved from upstate NY to Austin, TX on October first. My husband would be driving down, and we could not get into our new house in TExas until the first. He told her that myself and our baby would be flying in on the first of October, so we needed to make sure everyting would be there. She told my husband that it would be, and that if it got there early, they would simply store our things until the first.in the email with the quote, it states clearly that the delivery will be made within 10 days of pickup.

Our things were scheduled to be picked September 20 at 3 pm. I was phoned on the 18th around 5 pm, by Leila, stating that in order to make our delivery date of the first, our items would have to be picked up the next day at 5. I agreed because what other choice did I have?

The movers arrived two hours early, and I was not ready for them. They carried out items, and packed my television for me. My husband contacted Leila frequently about the delivery date and the last time he had contact with her was September 27th. She had assured him that the delivery would be there early. My husband made arrangements to get into our new house early, so that he could set up our baby's room (ie: his bed and toys) He contacted Leila again and she would not talk to my husband. He phoned again for the next two days, but Leila had decided to stop accpeting his phone calls, and stop returning his phone calls, ending all communication with my husband.

He called again and again and got Rachel, the other office representative. She informed him on Friday the 29th of September that our things would not arrive early. NOT only would they not arrive early, but they might be a few days late. He informed her that his wife and baby would be flying in on October first, that we had signed with them because they assured us, that we would have all of our items delivered by the first of October. She told him that they had an obligation to deliver the items within 10 days from pickup.

Ten business days would be on October 3. (Although they do drive and deliver on Saturdays, putting the actual date at September 30) He phoned Rachel back to ask her to reimburse us for a temporary bed for my son, and for dishes to eat and cook with. They offered $50.00! This was unacceptable! My husband was put in contact with the owner, who said he could not give us more than $75.00 for these items.

We found out that our items never even left ERS in New Jersey until October 2! Can you believe these people? Our items did not arrive until 7 pm on Saturday October 7th. One week after we had agreed to. The drivers that arrived in Austin helped us unpack certain items, and unpacked our television. The driver named Ty, couldnt believe that ERS had packed our television in a cardboard box with bubble-wrap. He noted that it was supposed to be packed into a crate. It was smashed, broken and unusable. We also moved a set of filing cabinets that had just been purchased prior to the move. They were so banged up and broken, that they did not serve their original purpose of being kept locked, or sitting up when the drawers were opened.

My two-year old was able to open them, and the whole unit tipped over on him when he opened it because the bottom is so smashed, making it sit unlevel. They are lucky that we caught him in time. I also had a box of Pier 1 dishes labeled "fragile". Every single one of them was broken. This was not the only box of dishes they had moved. There were others, but they all made it safely. The ONLY box broken was the one labeled "fragile".

We filed a damage claim for our items. Asking for the measely amount of $269.98, which we felt honest and fair. Rachel sent us back an offer for $25.00.
Can you believe these people? Not only are the office personnel shady, the movers lied straight to my face!

My stepfather and my mother were in the kitchen with myself and the foreman when I was signing papers. On the last sheet it said something about "30 days". I specifically asked him, "Woah, what is this thing about 30 days?" He replied with a wave, saying that it was only for us to store our things with them. He said that we would have 30 days to store our things for free.

There were two other people who witnessed this.
It may be my naivity for believing him. But, I just trusted him to be honest, as did my family. Later, when arguing with Rachel, my husband was told that they by law had 30 days to deliver our items, because I had put my signature on that paper. We denied the claim for 25.00 of course, Rachel countered with 50.00. She said if we deny this, we will not see a penny. We are filing a claim against them as our next step.
