Fraudulent advertising and sales of assets, receiving payment without delivering items sold. Ripoff

This company and man entered an on line auction supposedly selling a 2.57 caret diamond ring. The winning bid was mine at $3,450. With the seller, Anthony Jolly paying for express shipping.
(note that he collected an addtional $325.00 to cover all of the expences making the total sales amount $3,795.00)

I sent Mr. Jolly a cashiers check for $3,795.00 on 12/23/03.

Mr. Jolly sent a box via express mail through the United States Post office on 12/31/03 which had a small piece of bubble wrap, an empty jewelry box and a small hand written receipt for the payment.

The postal employee had me sign before being able to even view the box then immediately told me I would need to call the number written on the box. This was before I even knew the box did not contain the ring.

I called the post office immediately to alert them and file any documents needed.

They told me only Mr. Jolly as the shipper was able to file for the missing item.

When I called Mr. Jolly he said he would contact the post office and file any necessary paperwork.

I also informed him there was no documentation for the ring other than the hand written receipt (no appraisal)
Mr. JOlly promised to get back with me immediately after he contacted the post office.

He called saying he filed for the insurance on the ring and he would contact me as soon as he received payment.

After numerous calls to Mr. Jolly I finally took all of the auction information and shipping container to the post office.

After approximately an hour I found that the post office was unable to tell when the post office found that the box was empty but they were able to tell me that Mr. Jolly had not insured the package over the 100.00 standard insurance covering express mail.

They found it pecular that a company who dealt in expensive jewelry would ship an item of this value without buying insurance to cover the item in the event that it was lost.

They also pointed out that if the item was in fact genuine the shipper would have to verify the value of the item to collect any insurance had he claimed a higher value.

I contacted the auction service and explained what happened and found other customers had difficulties aquiring their purchases from this party and they had to become involved to cause delivery to occur.

Mr. Jolly evidently thought sending an empty box would take care of the burden of proof. Evidently he didn't think that receiving $325.00 and claiming he would handling on related shipping costs would make him liable to supply either a refund of my money or the diamond ring he sold me.

Supposedly he was working on getting a replacement ring. It has been well over two years and to date I have not received any of my money or the ring. Mr. Jolly is a scam artist and a thieF!!
