Ripoff Scammed Orange Amps Bad Deale

I entered into an oral contract (I have email as verification and documentation) with Red House Music to exchange 3 Marshall Amplifier cabinets and a Marshall Amplifier head for 1 Orange amplifier head and 2 Orange amplifier cabinets. I shipped my equipment to the Red House Music store and they shipped me an Orange cabinet and an Orange Head, however they claimed the second cabinet was on back-order until June. They had the head of sales at the Orange Amplifier company send an email me to verify that this was in fact true.

After receiving the message, I accepted the offer, expecting shipment on that part of the equipment on a later date.

To be certain I would receive the first batch of equipment from Red House Music I sent the Marshall equipment in two shipments a week apart. Several days after they received the second shipment of my goods I received an email (May 18) claiming that they were not happy with the equipment I sent to them. I explained to them there were no provisions in our agreement for any inspection periods or trial periods. [The reason there were no inspection periods is that Music Stores are NOTORIUS for trying to change the terms of a deal.] I explained in clear terms there were no provisions for modifying our contract.

I described the items as best I could; I also sent a photo of the actual items to be sent and I answered all direct questions accurately and honestly. I sent the items to Red House Music in good faith and only later did they have a change of heart on the deal.

They had the first shipment of goods for 6 days. I never heard one word from them other than they were excited to get the next shipment of goods, there were no hints of being unhappy with what I had sent them. Apparently they had sold some of the stuff before it arrived and must have lied and told the customer that it was new.

I get an email later from them about how unhappy this guy is What does that have to do with me? I'm not involved in any 3rd party deals. They insist that they have to restore the equipment to new. If they wanted new they should have bought new. The dirt bag manager Ryan Northrup then tried to claim that I misrepresented the condition of the items (which I did not). I never said anything was like new or mint or anything remotely like that.

I told this guy that they were in very good condition for used gear (which they were).

On May 19 the company tried to shake me down for $415.00 stating the outrageous claim that for them to fulfill their obligation under the contract I would have to pay money to them directly. They then threatened to not send the item valued at $579.00 (retail). I have several witnesses that will swear affidavits that the items I sent were 100% functional and in excellent shape for USED goods.

This company has breached a legally binding contract, attempted to extort money from me, and they have defrauded me of promised goods. I have filed a complaint with the Attorney General's in both Ohio and Nebraska. I am also suing them in small claims court.
