Two of my boxes not delivered One box delivered that is not mine

When All Victory Moving and Storage delivered my shipment on 9 December the deliverymen, who were in a hurry to leave, forced me to sign the Bill of Lading without allowing me to properly count and inspect the items that had been delivered. When I went through the items on the following days, I discovered that two of my boxes were missing and one of the boxes I received is not mine.

I called All Victory Moving & Storage immediately. After allegedly attempting to locate my missing boxes, Ron, the dispatcher I dealt with, said he could not find them. How did Ron justify this?"This is moving - stuff gets lost, " he said to me flippantly. "Here and there things happen, " he also said uncaringly. Further, the company seemed unconcerned that I had another customer's box. I also called the deliverymen, foolishly thinking that they would care about their mistake.instead of caring, they argued with me and insisted that I was wrong, that I was not missing any boxes and that I was not delivered a box that is not mine.

I sent a claim to Victory's claim company, Anthem Claim Management. Unbelievably, they state in their response that, "we can find no liability on behalf of the carrier." What?! Who could possibly be to blame for my two missing boxes if not the carrier? And who, but the carrier, gave me a box that doesn't belong to me?

Anthem is attempting to shirk responsibility for Victory by pointing out that I signed the Bill of Lading. This is, of course, LUDICROUS because (a) the delivery men hurried me to sign the paperwork and did not let me properly count and inspect the items that had been delivered and (b) I had no way of knowing that I was delivered a box that is not mine until I looked through them.

The response from Anthem contains comments that do not even apply to my case - such as damaged furniture, which we do not claim - suggesting to me that they never even read my claim. Not surprisingly, Anthem refused to pay out on my claim for the contents of the two missing boxes.

I am sending Anthem a response to their letter, explaining in simple terms that (a) two of my boxes are missing and (b) I have a box that does not belong to me, both counts on which Victory has CLEAR liability. I am giving them one more opportunity to do the right thing in this situation and pay out on the contents of the two missing boxes. If they fail to do so, I plan to pursue legal action - possibly Class Action given all the complaints on the Internet about them and their F rating with the Better Business Bureau.

I will post a response to this site after I hear back from them.in the meantime, here are the details of my missing boxes and mistakenly delivered box:
* My shipment was Lot No. AA1065 with orange Victory Moving & Storage stickers. One of the missing boxes is #047 and is a long white file box (12.5" x 11" x 24") filled with papers from four years of Doctoral research. The other box is numbered either 051 or 083 and is either a standard small or medium packing box. It contains a flute, clothing and books. Both boxes may also have white stickers (Lot No. 145723) from a previous move (not by Victory).
* The box that is not mine is labeled with "Capp" (or Carr?) and
contains a variety of items, one of which is engraved. I realized pretty quickly the box was not mine and did not go through all of the contents. If this is your box, you will be able to confirm for me the sticker color, lot number and engraving on the engraved item.
