RIPOFF Discriminatory hiring practices, falsely blamed others for their decision

On 18 DEC I was contacted by the employer regarding an online application I had completed for the position of tractor-trailer driver. I explained my experience, work history, safety record, etc. To them. I also explained to them a deeply personal medical issue which DAC (now USIS) has been making freely available to the world, just to make sure they wouldn't have an issue. After all, no one looking for a job wants to waste time with an employer who judges job applicants based upon anything other than qualifications, skills, and abilities. Glenda Morales, the driver recruiter, assured me they had no issue whatsoever. They faxed me an application, which I filled out and faxed back the next morning, along with copies of my license, social security card, and medical card.

On 23 DEC Ms. Morales called to say she could not hire me, because of a report from Werner Enterprises, Inc. (a former employer) claiming I had 22 accidents/incidents which were "driver at fault." Anyone who has been in the trucking industry knows that dog don't hunt. I contacted Jesse at Werner, who told me they made no such report. I was instructed to have the employer contact him directly for accurate information.

When I contacted Ms. Morales at Voyager, she claimed that it was the insurance carrier's decision, not hers. I explained the information she had was in serious error, and to contact Jesse at Werner. She claims later to have done so, but that the insurance carrier counts ANY incident or accident as "driver at fault, " regardless of the nature of it. I had 1 accident in 1999, the remaining issues involve my work as a third party reporter of equipment damage, theft, etc., with said reports made by myself as part of my job.

I contacted the insurance carrier underwriter, who claims they were never contacted by the employer. The insurer also claims they have zero involvement in the employment decisions of their customers.

This is the short version, it gets a bit more complex, but this version portrays accurately what transpired. This is the first time I have encountered an employer who not only has discriminatory hiring practices, but is such a coward about it they blame others for their own fear and ignorance. Their stories also changed, with many inconsistencies in the various versions I was told.

A complaint is to be filed with the Colorado Workforce Center Veterans Unit (yep, I served), as well as the California Fair Housing and Employment Commission (I am technically a CA resident, and the employer lists CA as their home state). While I hate bigotry, I hate liars who waste my time far more.

Needless to say, I wouldn't work for this employer ever at this point. If they were so willing to lie about something they could have been totally honest about without consequence, who knows what else they would have lied to me about.
