On or about 8/1/05 my husband put his rental property up for sale. We knew the roof had to be replaced, and obtained an estimate from BRC High Tech Roofing to complete the job, to be paid upon closing.
On 8/10/05 at 6:32 P.M. We faxed an acceptance on the estimate, and provided information that we had a contract, and the expected closing date was to be 9/8/05.
A rep from the roofer stated it wouldn't be a problem, as it was a small roof and could be done within a short time frame.
2 weeks later (8/24) our tennant and the next door neighbor advised us that a crew had come out, took one look at the job and said "F this, no F-ing way" and walked off the job.
Repeated calls were made to the company to find out what was going on, and why it was taking so long to get a "little" job done. We were told by a man at BRC that he was having "staff issues"... Apparently he was subbing out jobs, and must have underbid the job to the sub-contractor.
At this time we were quite adamant that we knew the closing was in less than 2 weeks, and since it was an occupied structure, the roof *had* to be completed or the closing wouldn't happen. The man at BRC reiterated that it was NO PROBLEM, and it would be taken care of, in a worse case situation, he'd have the job completed by the 8th.
My husband recieved a call from his broker on 9/6/05, she had been by the property, and NO work had been started, and because of that, the closing would have to be delayed.
We made multiple phone calls and left messages, and have yet to receive a return phone call. The best part is that we now have until 9/23/05 to get the work done, or WE are in breach of contract, and the purchaser can walk away from the contract & WE can be charged for the buyer's out of pocket expenses since WE failed to deliver on the contract!
It probably wouldn't be such a bad situation, but with Ophelia expected to be dropping massive amounts of rain thru Mon or Tues (9/12-13) and another storm right behing it...
Unfortunately we are being advised that we have NO recourse against this company as we haven't paid them for the work.
