Sold bad units and won't honor warranty

I contacted this company based on their ad placed on Craigslist.org. The ad stated the machines were in excellent looking and working condition, plus a free 90 day warranty on parts and labor. Another ad of theirs stated there is free delivery within 35 miles in the local area. I spoke to Al who said he could deliver the units that evening around 7pm. He was held back on another job and I suggested we waited until the next day because it was getting late and I have three kids I need to get to bed. He stated he was already on his way. After several hours he stated he was lost and again I suggested we wait until the next day but he said he was up the street from my house and needed me to drive up the street to help him find his way to the house. Eventually he arrived at my house with an assistant at 11:00pm.

I told him I was nervous about purchasing used equipment especially since I was not able to really inspect it so late in the night. He assured me repeatedly that I would not have a problem and that I would be covered by the 90 day warranty which includes replacement, parts and labor. He told me I would have to pay $350 for the units and $50 for the delivery and he would take my original units for free.

The next morning I went to do a load of laundry. After a while I realized that the units were badly spray painted, in which the paint was bubbled, painted on top of dirt, in some places coming off and had dried drips. Then I realized the dryer was not drying. Being that the ad stated they were in excellent looking and running condition and I knew I didn't feel comfortable not being able to check out the appliances first, I called him back on both numbers given to me at 7:30 am on 5/25. I stated I didn't want the units and I wanted my money back and I wanted my original units returned. After not hearing back, I sent an email to document my calls and my request for the return.

I eventually received a call back from a lady named Crystal who stated to me that there are no refunds. I explained that this was never disclosed to me. It is not on the ads nor was it on my receipt. She stated it was on their web site. I explained that I was unaware that they had a web site. (To this day, I have yet to find their web site) I explained that I was within the first 3 days of my purchase and I wanted my original units returned to me, these units they sold to me were not as advertised and I wanted my money back. She stated I would have to speak to Al but he was not there as he left to go to the mountains to buy more units and didn't take his cell phone. I thought that was an odd thing that he would have to go all the way to the mountains to buy units and not taking his cell with him.

I waited three days and called again. I left messages. Crystal left me a message on 5/28/09 at 2:45pm stating that this was a courtesy call and they would bring me new units. I never received the new units. I continued to call.

About a week after the purchase, I finally reached Al on his cell by using a different phone. He told me he had a family emergency that his Aunt and Uncle were involved in a hit and run in New York and his Aunt died and his Uncle was in the hospital. I gave him my sympathy and didn't want to bother him during this tough time.

I waited another week and called. He stated that he was still in NY because they were not releasing his Aunt's body because of the investigation. I waited another week. He told me he would arrive at my house sometime on Wednesday, June 10. I emailed them and called them to see what time they would be arriving because I had to go see clients. They never responded.

Finally on Friday, June 12 Al arrived with his wife and daughter. He stated he didn't have another set to replace this set and would attempt to repair this unit until he could find a replacement. He used my vacuum to get a huge amount of debris out from the dryer. He said this huge clog was what was preventing the dryer from drying. He said they had a child's ball game to go to but would call me to make sure it was still working.

I did some laundry right away to realize that the dryer was still not drying. I called and his wife stated that maybe I was using the wrong setting. I explained that I was using the hottest temperature and the vent trap was clean. They said maybe my dryer vent to my house was clogged. I explained that I just had all my vents including the dryer vent professionally cleaned 3 months ago. She said Al would call me back.

I didn't hear back from him so I called the next day. He couldn't talk to me on the phone because he just had oral surgery. Sine then I have emailed and called. Eventually I received a response from his wife telling me that Al is out of town for several weeks and she can't do anything until he returns.

I went back to craigslist.org to print out the ad and prepare to file a complaint when I realized that the ad stated the untis were only $300 together and he charged me $350 and his other ad stated free delivery and he charged me $50. I felt cheated and lied to. Now all the excuses seem likelies and I responded letting her know I was filing a complaint and I wanted my money back. She stated there is no refund. I reminded her that there is no disclosure of this and I was not made aware of this until after I paid them $400 cash.

Later, she offered to send a guy over to replace the dryer with another one but I explained that I was aware of their lies to me, how they over charged me, I was intending to buy a matching set in excellent looking and working condition as they advertised and they fell short on their promises. I also let her know that with all the dishonesty, I didn't trust any appliances coming from them.

I have since purchased another set and I want them to return my original units as I asked from the beginning and refund my $400. However, they are just ignoring all forms of contact.
