Sun Lakes Home Owners Association Unfair late charge assessment

I have a problem regarding my Homeowner's Association and their policy of assessing fees.

I live in Cottonwood section of Sun Lakes and we were notified last year that each family would be assessed $1,400 for renovations of our area. A form was sent requesting that we indicate how we wanted to pay this special assessment. My husband and I decided not to pay the whole amount but to opt for a monthly payment. I wanted to send the first payment in February, but could find no info on the date of the first payment. I called the office and was told by the accounting department that I was late with my payment. I disagreed because I thought the first payment was in March and it was now about the middle of February. I was informed at that time that the office had no response from our home about how we wanted to pay this assessment. I argued that my husband had delivered the form and had put it in their mailbox, since the office was closed. The woman on the other end stated that they had nothing from us and that we would have to pay a $20 late charge. I became angry at her attitude about this matter without any consideration when we knew we had sent the form back. I then told her to forget it and I would pay the entire assessment. My husband took a check over to the office to pay the entire amount. He was then told that we would have to pay a late fee of 10% or $140, even though the entire amount was paid.

I think that the people there are very mean-spirited and have far too much power and are totally not accommodating. Why should I pay a late fee when I'm paying the entire amount, especially 10% of the entire amount! Also, I was less than a month or so late, and since I was paying the full amount, why could I not get a break — they got their money! I get more consideration for my lapses from my creditors. I have never been late for my HOA dues, in fact, they are sometimes paid up for the whole year or in bi-weekly payments. I understand the purpose of late fees to encourage a steady flow of income for their purposes; however, what they are proposing to me is just a punishment because the lady did not like my conversation. Who gives these people so much power over seniors, who are prone to lapses. I think a little consideration is in order.

I called the office back to discuss this matter and the woman told me that I had to pay $140 and there would be no more discussion on the matter. I guess she thinks she speaking to a child and I feel helpless.

I contacted Nancy Peannebecker, the President of the Homeowner's Association for Cottonwood, twice and left a message. She never responded to my calls, which is not surprising since I have never had good experience with the Board since my car was stolen twice in 1 month after moving here.

I then contact the office manager (whose name I do not know) and explained this situation to him. He acted interested and said he would look into this problem; however, it has been at least 3 weeks and I have not heard anything from him.

Is there any help or direction (outside of legal action) you can offer so that I can get some relief from this problem. I would appreciate any help I can get, as I don't know where to turn. I think they are taking unfair advantage in assessing such a high amount after the total amount is fully paid.
