In 2002 my ex wife and i went to department of child support services in san diego so that my child support could be recorded. Im still not sure why because the court order from 1997 showed i had to pay about 575.00 per month and she was getting around 1000.00 in 2002 when her husbands ex wife took him back to court and had his child support increased they came after me to have mine increased. I didnt care because at least i know it will be recorded that i was paying my support. I am a disabled american veteran. My ex wife is an employee of san diego county. While sitting in the dcss office trying to sort out what i was required to pay i stated that since she receives an amount from the veterans administration directly to her and from the social security administration in derivitive benefits that this should be included as child support payments and reduce the amount owed by me. The lady working for dcss looked at her and said well he has to prove you get that money and she said well let him prove it. So i didnt think it would be a problem. The support was ordered and i paid it every month however when i went to the VA and Social security administration i was told that she had locked up my account and i was not to be given any information about her or my children. So i could not prove she got that money. I tried so many times to call dcss and let them know what was going on and they would always hang up the phone on me and say they had to terminate the call. I received a notice from dcss stating that i owed 28,000 dollars in arrears and there is no way this was possible how could i owe 28,000 in arrears when the payment record i received from the county even showed that i was paying my support payments as agreed. Ill tell you why. She is a county employee and she had already told me that she knows people in the child support office and they were going to attach my check, suspend my drivers liscense and my bank account. I tried to call the county back and explain to them what she had said and once again was hung up on and i was told they have to terminate the call. I eventually called her and told her that she knows i dont owe that much money in arrears because the only time i wasnt able to pay support was when i was in the veterans hospital getting my mental health condition treatd from desert storm. She called me back and said i owed only 9 thousand and something and i had to go back to san diego to fill out and sign a form in front of a notary and submit it to the court. We did that and the court accepted the form. So many years passed with me always getting hung up on by the county and them not listening to what i had to say that i honestly dont know if some of the people i tried to speak to were her friends who also work for the county. She has worked there now for 23 years. My oldest child turned 18 in july. At that point my support payments dropped to 263 a month for my youngest boy. Once again i tried calling so many times to make sure that the amounts she received directly were being accounted for and we know what the result was. They were garnishing my social security check and took 50% they were crediting my account with the amount of the garnishment applying 263 for support and the balance towards the arrears. You would think that was fair but with her being a county employee im pretty confident she was able to manipulate the case from the inside and cause a massive over payment. Because they would not listen to me and would hang up on me every time i called my hands were tied and she and her husband talked so bad about me that since that time neither child will talk to me. She received 502 from garnishment 502 from social security and 150 from veterans administration for 263 worth of support the balance of which should have been applied towards any arrears. Now i have paid my support and the child support office is all but admitting that there was an overpayment but can do nothing and telling me i should leave it alone because it doesnt appear that interest was being charged. How can interest not be charged when we both agreed that there was 9 thousand and something owed in arrears and it grew to 14K in a matter of time. Thats interest if ive ever seen it. They took my stimulus checks they took a portion of an accident settlement they garnished my wages they suspended my drivers liscense. I tried to explain that there was a conflict of interest but they refused to listen. Ill run down what i can prove. I can prove what the amount of support was in 2002 i can prove that i was paying that amount as agreed so if she didnt use one of her friends in that office how did i get a notice stating i owed 28k in arrears and why did i get a notice from social security administration and the veterans administration stating that i was not paying my child support and my checks would be garnished. When even the dcss records show i was paying as agreed. I can prove she was being paid more than the court ordered amount prior to moving this to dcss. I can prove that the county knew she was getting derivitive benefits via court order in 2004 i can prove how much she got sent directly to her from social security and veterans administration and how much the county garnished and how much dcss gave me credit for each month. I need someone who can sue the county for making this extremely costly error and allowing what i consider as a corrupt county employee to have her hands in this creating a serious conflict of interest. And now the dcss is telling me that there not going to make her pay me back so we will need to sue her and make her pay me back. Anyone who is willing to help me out will have to wait until settlement to get paid. I have no money but will be happy to agree to a percentage upon successfully recovering
