Empire Today - Never Installed Product and Won't Refund Money

We have had a horrible experience with Empire Today that has yet to be resolved. We signed up to get laminate installed in the living room, dining room, entryway and powder room and vinyl installed in the kitchen. The installers showed up as scheduled on Saturday, April 14, but the laminate installer said it would be impossible to install laminate in two of the areas we had ordered it for (bathroom and entryway). He said the salesman should have never sold us the laminate for that area. Before the installers did anything, I called the salesman. He said we could switch it out for vinyl which would be a $422 savings. He said we had to pay the full laminate amount or the installers wouldn't start and we would be charged a rescheduling fee. He said we would be refunded the $422 difference in price. We went ahead and paid the full price via debit card and the full price of BOTH the laminate AND vinyl were deducted from my checking account. They couldn't install the replacement vinyl that day, so they came the next weekend. We still have not gotten the $422 that Empire Today owes us and it is now June 20. We have called numerous times and talked to the salesman, Jake, and a "Customer Service Manager" Tory. First, they tried to say that we didn't pay the full amount when it was first installed. Then they agreed that we did pay the full amount and they would be sending a refund check. That never happened. Then Tory said once again, that the price we had originally paid was right. When I explained that there was no way that was possible because the original price was for laminate, not vinyl, he said he realized their mistake and that we did pay the full price on the date of installation and the credit never did go through. He claimed he was "putting the credit through" last Friday (June 15th). The credit never went through. Yesterday (Tuesday, June 19th) he called and left a message that he wasn't putting it through after all because the price we originally paid was right. They have been jerking us around like this for weeks. We paid for laminate that we never received and now they are unwilling to correct their mistake.
