Subaru "confidence in motion" but not confident to fix a problem

I have a brand new 2010 subaru forester which we got during the 2010 clearance in January. There is less then 25,000kms. The car overall has amazing handling, however there has been alot of little issues. One of the biggest issues and ALOT of forester owners are going through the same issue. One of my tail lights has an EXCESSIVE amount of condensation to the point where in the winter the entire light froze on the inside and you could barely see that the light was on or you couldn't see the turning signal which poses a traffic hazard. I have contacted numerous subaru dealers which have said they have many cars 2010 with the same issue however Subaru has deemed it as a "normality" and will not do anything about it. I spoke with customer service who quite simply brushed me off asking if I park my car inside or outside, which ways the lights face the sun? And said they are aware of the ": problem" but it is a normality. How is it that I just took pictures of my car and all the lights are dry and clear but one is covered with condensation and that is a normality? It is a brand new car and subaru will not even fix it through the warranty. I had one dealer kind enough to say they will not charge us to take the light apart and try to dry it out but how will that stop the obvious problem and when I asked the gentlemen who was trying to help out "what if the problem continues" he avoided the answer and said we have had some luck drying them. Why is it that Subaru "CONFIDENCE IN MOTION" will not stand behind their product and replace a light? Or do I have to cause a traffic accident in the winter because the car behind me cannot see my turn signal for them to notice and fix the problem the company is well aware of? Subaru is aware that many 2010 models as per customer service and numerous service departments that the lights have this problem but subaru is deeming it a normality and will not remedy the issue from ceasing and not happening again.
