For the past three years the state of Florida's Child Support Enforcement Division has intercepted my federal income taxes. Admittedly, I have been behind one time in those three years and understood when the taxes were taken to pay my arrears. Since the first time, I have never been behind one time in my child support, but still the money continues to be intercepted.
Even when I have been able to prove to the child support case worker that I was in fact not behind, the still continue to put liens against my taxes "just in case" I ever fall behind. I live in the state of Missouri and pay my taxes to the county in which my divorce was finalized. The state of Missouri shows my case as being current, but the state of Florida always shows me as having a balance in arrears.
After the State of Florida intercepted my taxes last year and I was able to get the entire matter squared away, so I thought, they sent my income taxes to my ex-wife anyway, even though they knew she was not due that money. My ex-wife cashed the check with the case workers permission and then told me I would have to get the money back from my ex-wife myself and then proceeded to zero out my account without giving my credit for the over paid amount. It would cost my 2-3 times as much to fight to get the money back from her and the child support division knows this.
I have fought with this agency for the past 2-3 years constantly with countless phone calls and much frustration with no avail. Then I find out today, even though I'm over paid by more than $2,000, they have put a lien against my taxes again for this year. How do I get this to stop? I even have my ex-wife calling me requesting that I file my taxes because she needs the money again!!!
