I agreed to pay 29.50 per month by auto draft for tile & masonry leads in my area. If I accepted the lead I would for an additional fee receive the contact information of the person making the request.
I did not accept any leads. Within a few months I received via e-mail several leads with contact information (not what I agreed to) I deleted to e-mail and did not use the information. I called Servicemagic to report the error, no one returned my call.
I was unaware they were charging my asccount until I received a overdraft notice (2 in one week). I went to the bank to find out what happen, that's when I discovered Servicmagic's action. I had to show proof of what was authorized the, the bank reversed the charges but left me with the $75.00 in overdraft charges.
Servicemagice amitted wrong doing, but still want $300.00 from me for they bad charges and $60.00 the bank charged them.
A servicemagic representive sent a e-mail amitting the error, but they have turned me over to collection.
Do I have to sue them to stop this and recover my $75.00?
