On October 8 I moved into the summit apartments located in Corpus Christi, Texas. The apartment needed some repairs, which i gave a list to the apartment manager Dana. The only thing they did not fix was the bathtub in the front restroom and the toilet seat in the restroom in the master bedroom.
Before signing my lease i explained to the apartment manager that my monthly rent would be paid on the 15th of every month if not a few days later depending on when i received my mortgage payment from my rent house. She agreed along with Joseph the gentleman that signed me up at the apartment complex. She did inform me that i would have to pay late fees if any accrued, i agreed to these terms.
In the summer of 2003 they hired a company to fix a real bad irrigation problem at the complex. It literally separated and cracked the walls in the master bedroom and the second bedroom, it was horrible. I immediately contacted the manager, she came and inspected the apartment and informed me that the problem would be immediatedly fixed, it never was. The following month i called and spoke to Lillian, she told me she would send someone right over, maintenance never came. The patio screen came off the roller due to the same irrigation problem, it was never fixed.
I complained about no hot water three different times, they claimed there was a problem with the hotwater switch. My neighbor upstairs started complaining that water was leaking from my apartment onto the sidewalk outside. For two months they did nothing. The third month i complained again this time they came out and checked my waterheater. The manager informed me that it is a miracle my apartment had not caught on fire.
I signed a new lease in October they informed me that they would fix everything broken or in need of repair. The walls, the carpet stains, the patio door, that is the only reason i signed a new lease. They had to do a credit check on my son because he was turning seventeen and a senior in high school so he had to now sign the lease. I paid 35.00, he signed everything was fine until December.
My apartment was broken into 12/11/03 in the daytime between 2:00 and 4:00. I called the front office i was told, you know that we have been experiencing break-ins there is nothing we can do. The problem is the tenants had only been told about one breakin, only after the police came and took finger prints did i find out we had had multiple breakins. The burgular kicked in the front door. Again the cop said this was because of old door knobs and outdated standard locks. I had had enough i told them either fix everything or i was sueing. They rejected my rent for December, claimed i never signed a new lease in October, evicted me in Feburary. Nobody from corporate would talk to me. During the robbery they took some of my personal papers including the copy of my new lease.
The only proof that i have of the new lease is my sons credit report, and criminal background check. On 2/20/04 they sent me a bill for $4063.40 the worst part is they are even trying to include my son the minor they claimed never signed a new lease. I have pictures, paperwork, money order receipts, statements to back up all of this up.By the way guess who they fired in December. The manager their office turnover rate is atrocious.
