Restaurant.com sells gift certificates for my restaurant. They charge anywhere between $2 and $10 for a $25 gift certificate. I asked them to remove me from their website and was told there would be a 90 day cancellation period, where I would have to continue to honor them. I agreed to do so. When my 90 day period was over, they still sold more. They claim that I did not accept the gift certificates during that 90 period, which I did. So the 90 day period started all over again.
There was also supossed to be a limit of 30 sold per month. For the 6 months of this program they have sold over 300 gift certificates valued at $25 each to my restaurant, of which we dont get any profits. My lawyer has sent them several requests for their cancellation policy and for a written contract stating that they will take us off their website at a specified date, to which we've gotten no response. They did however call me directly (which my lawyer told them specifically not to do) and inform me that they will send me to collections for every outstanding gift certificate (they claim there's 198 of them) even though they are the ones that sold them, and the ones that got the money for them.
