To whom it may concern:

On Sunday 11-07 my car was involved in a car accident. My car was towed to a near by body shop called Excellence CollisionCenter Inc located at 1450 NW 21 St Miami, FL 33142 305-548-3232. At the time of the accident the tow truck driver George ensured me that I would not have to pay any storage fees and that I would be able to rent a car at the body shop while my car was being fixed. Once I got to the body shop and was arranging everything, I again asked George and his fellow co-workers are you sure I don't have to pay any storage fees they replied by saying no the car insurance takes care of everything. I proceeded to contact my car insurance All-State while at the body shop to inform them and summit a accident claim report. All-State stated that I didn't have collision and that I would have to contact the other person's car insurance to submit a claim and have them pay for the damages. I then contacted Red Land and submitted my claim with them. About a week later after speaking with several people about my car accident they instructed me to make sure the body shop wasn't going to charge (ME) any storages fees while the insurance companies did their investigation. About a week later I contacted Excellence Collision Center and spoke with Diana, I inquired again about any storage charges and she replied by saying no we do not charge you for anything we bill the car insurance for that. Finally After 3 months of both company's claiming to have done their investigation they both denied being at fault since no one was issued a ticket. Mean while I have continued to pay car insurance while my car has been sitting in storage waiting for either insurance company to assist with the damages. On Saturday 02-05, I received a letter from Professional Lien & Title Services located at 10544 NW 26 St suite #E-102 Doral, Fl 33172 305-592-6090 stating that a Lien was placed on my car for $3,235.00 with a continuation of $50.00 per day until March 04 when they will auction my car. Monday morning I immediately went to speak with the manager Carlos at Excellence Collision Center and informed him that I could not lose my car and that I was having issues with both car insurance denying to pay for the damages. He then advised me to press both companies to try to get an answer so I wouldn't have to lose my car come auction day. I asked Carlos to not auction my car he said I wont just keep him posted before the auction as he is one that has the final say if they auction it or not. I thanked him and for the next few days I made several phone calls to the insurance companies, unfortunately it fell on deaf ears.By the end of the week I once again went to speak directly to Carlos and informed him that both insurance had once again denied the claim and that I had to pay out of pocket for the damages. I reminded him to please keep in mind that I had originally arrived to the shop in good faith and with all the intentions of getting my car fixed at his establishment. I asked him to Please give me an estimate for the damages and to also please assist me with the lien placed on my car. He advised me that he would remove the lien on my car and I wouldn't have to pay anything as long as I fixed my car with them. I agreed, he replied that he would contact me in a few days once he had an estimate ready. Today, Friday 02-19 I was contacted by Diana with an estimate of $5,442.06. At that point I questioned why the estimate was so high. Diana suggested I come to the shop and Carlos would explain the estimate and what needs to be done to the car in order to get it repaired. When I arrived at the shop I asked for a written estimate to see what exactly was going to be done for $5,442.06. After reviewing the estimate not only did it seem to be over charged but I noticed my car had much more damage than the day of the accident. I asked Carlos what had happened to the car and if they had to rip out part of the car to give me an estimate. He said it came like that. I also noticed over spray of white paint all over my car, I asked Carlos about it and he said ooh no it's just very dirty from the tree above. I took a few pictures at that moment and when I arrived at my home I compared them with other pictures taken by my wife the day of the accident. They are major differences between the original pictures taken at the scene of the accident and the pictures I took at the repair shop. I'm in a situation with limited resources to have paid for the damages since it was out of pocket. After several attempts to contact Carlos I was finally able to speak with him today 02-24. He told me that just to get the car fixed it would be roughly $1000 but then I would have to pay for lien and storage fees which would cost me over $2000 for everything else. I have attached 6 pictures of the car. The first 3 pictures were taken on 11-07 at the scene of the accident. The last 3 pictures were taken on 02-19 at the body shop. I am asking for assistance and or guidance with this issue. I truly feel that this body shop has done me an injustice with the added damages. Please advise me what options I may have after bonding out my car on 03-04 for $3,235.00 and no repairs were ever done many thanks in advance. Diego
