Questionable Practices

I went to buy a car on August 18th, I was trading in a 2009 Nission Frontier (miles 18,000) Truck has nice lift and was in excellent condition. I purchased a 2009 Convertable Eclispe (14 miles) sold as used. (Mitsubishi Victorville bought this from store that closed in Lancaster (so they claimed had to sell as used). I was told that in order for the deal to work, I had to purchase Gap insurance ($ 750.00), certified warranty ($ 1,500.00), both coverages are listed as options. I was told that if the apprasier called me to tell them that the car had leather seats, upgraded stereo system, etc. At the time I was not sure why. I now know that it was because of the car not bluebooking to the apprasied value. After I bought the car is when I received a call from the appraiser, and I asked them why do you need to know this. (SO now I am a party to questionable practices as well) I also needed my husband to sign the contract. I was given the car to take home (seat belt was broken, they did not have a problem with me not being able to drive home safely. I did not receive the manuel or the signed contract. I was told they would overnight this to me (they never did). I went back there and was told that no one new a thing about this. At this time I was given a 2011 manuel, along with a copy of the contract. When my husband got home, he told the dealer that you let my wife drive home in a car that had rotted tires with no tread, the car had no head lights for night driving. The dealer told us that they swapped the new tires (not sure who did it), and had no explanation for the head light situation. My husband fixed the seatbelt (required by law to drive with). Mitsubishi took tires from another car that was on the lot 9 ready to be sold), and swapped them on to my car. A month later I get my monthly statment for my old truck, and found out this was not paid off by Mitsubishi, I figured must have crossed in the mail. When I receivd my next statement I was now behind two payments. Mitsubishi finally sold my truck on September 22 which is when they then forwared the payoff amount that was quoted for (good until September 15th). When Mitsubishi finally sent the payment, the payoff amount was incorrect (interest) was still due. Needless to say my credit which is excellent is now comprimised. I went back to Mitsubishi, and was told (oh we will right a letter to the credit bureu and explain). Anybody ever deal with getting late payments off your history (I have many years ago, takes a very long time). I have been back asking for them to reverse the contract, to my orignial and give me back my truck (they sold it), so I aked about purchasing a another vehicle as I did not want to drive a car representing the dealership or Mitsubishi. I chose a Nission, and a Nission Titan which were both at the same price as the car I purchased. Well now after being told we will work out the best deal for you just to make you happy. They now want an adittional $ 5,000.00 to make this deal work. I have called twice to the CEO (Chuck Chatles, 949-525-0581) name given by Jimmey the sales manager). He will not reutrn my calls, and Jimmey claims he spoke to him about my situation. Jimmey also claims I should not have been treated this way, and agrees that the contract is questionable. I am very upset that these practices are allowed by a car dealership, times are extremely difficult, and when a dealership uses practices such as these, and treats a customer like this, there should be something that can be done.

Respectfully, Charlene Brownell
