SOUTH CHICAGO NISSAN - LARRY (SALESPERSON) JOHN (SALES MANAGER) JAY — Submitted False Information On Credit Application

I accuse South Chicago Nissan is guilty of submitting false information on my application for financing and emitting true information. They put my previous job information in the place where my current income/job is suppose to be and leaving the previous job section blank. The information about my present income situation was not submitted anywhere on any document. The salesman has denied me telling of my present income situation. I am a senior on social security disability. No one at the dealer will admit that they were told this information. I can't prove that I told them I was on Social Security Disability. I told them this information when I first came in the door. More than once and I also told the finance person too that is why I am so hurt that they left that information out of my application. The previous job information covered a job I worked on ten years ago. I have been disabled since 1995. Since 1999 I have been receiving Social Security Disability and a Disability Pension from the job I was working on.

The problem in my situation is I did not see the actual application for financing and I did not pay close attention to the paper that I signed that had a lot of small print. I only found out the misinformation part of it after I talked to the fraud department of Nissan and the representative sent me a copy of all the papers I signed. I have since voluntarily given the car back. I did drive the car to the lot and gave them the keys but they drove it back to my house. It is only when I started the fraud procedures did they come and get the car very fast.

The main reason I wanted to to return the car was because I realized that the monthly payment was way too high for me to afford the car on my disability income. I could not even make the first payment so before that was gonna happen I went back to the dealer a few days after I bought the car and I asked for a lower payment but they did not want to do that. When I talked to the big boss who after many attempts for him to give me his name, said his name is Barry Neshal told me that "the contract was not made in stone and that when I got my first payment invoice I should just pay what I could". I took him at his word because he said he was the Big Boss. I went home and called Nissan Corperation who took the contract and they said "No Way" So then that is when I took the car back to the dealer and then they drove it back to my house and then I filed a fraud case and then they came and got it.

I talked to a fraud investigator named Will Dress who said "I believe you Mr. Ducote but you have not shown me any proof that they left out your correct information on the credit application on purpose. So I can't help you I'm sorry". So that is what I am trying to do now. I am asking for any help in this matter I won't give up. They have really hurt me by doing this. It is like some kind of conspiracy or something. Has any one else had this experience please let me know. Thanks and good luck to you all.
