An elderly woman saw a sign about protecting roofs while she visited the miami florida home show in the fall of 2007. Mr. John a gorman sat at the booth and introduced himself as the owner of best quality and service co., llc and told the woman he had been in the roofing business for many years with his son john gorman jr.
After the sales pitch, the senior citizen invited mr. Gorman to her house for an estimate.
Mr. Gorman went onto the roof and returned to write a handwritten estimate of the work which would amount to $3,450 but due to her age, she was given a discount of 15% which brought the amount to @2,987.50
The woman told mr. Gorman she could not read the handwritten contract proposal and wanted a typed one instead. However, the job was done and she paid him the @2987.50 by personal check, addressed to best quality and service co., llc.
About a month later, a typed contract proposal arrived that had neither john gorman's or the woman's signature on the proposal. The only referrence to john gorman was the incorrect name of john forman in the box marked representative. When reading this report one might think it was just a typing error. But when seen in it's entirety, it was the beginning of a scheme to defraud.
The contract called for the company to patch leak in flat roof;sweep back gravel, install new mastic & modified bitumen; sweep gravel back into place and tighten all loose tiles; pressure wash tile roof and apply elastomeric roof coating (white) to flat and slope roofs; top coat with 1 coat of roof-guard 102;
The contract proposal included a 10 year unconditional warranty for labor and materials; roof-guard with a 7 year manufacturer's warranty.
It has been determined that neither john gorman sr. Nor john gorman jr. Were ever licensed with the department of professional regulation in florida. John gorman gave an address that can not be located by either google or yahoo.
The roof-guard warranty is useless because the company that authorized best quality and service co., llc cut them off for many reasons including no receipt of any warranty registrations.
Best quality and service co., llc is owned by michael p williams who is listed as the principle holder of the florida license ccc1328261. He told the woman he was just the manager, not a roofer. When she complained about leaks immediatedly following the first rain after the work was done.
Mr. Williams never went onto the roof to either supervise any work or perform any professional duty. Since both gorman men were un-licensed roofers, no certified roofing contractor was either on the roof or did any work/supervision on the job.
The three men were unable to locate and repair any of the leaks and eventually abandoned the job site, telling the woman they would not return.
The woman filed a formal complaint with the department of professional regulation for the state of florida and a copy with the company's agent on january 13th. Both gorman men were removed from the best quality and service co. Llc on january 21st.
Leaks became so bad, holes had to be drilled into the ceilings to prevent the ceilings from collapsing from the weight of the water.
