I purchased a vehicle from Drive Time in May and have been paying faithfully every two weeks since. I was laid-off and lost my job this past May, but I contacted the Drive Time where I purchased the car and offered to return it when I had to depend on Unemployment as my only income. I was told that even if I returned the car, I would still be charged for the balance of my loan. This made absolutely no sense to me as the reason I would return the car would be to avoid having to pay money I didn't have. Why would I do this and still have no transportation too? The agent at the store agreed to accept $100.00 every two weeks instead of the $192.00 that I had been paying so that I could keep up with my rent and insurances until I can find another job, and I have continued to do so. I have not missed a payment.
However, my family and I am now being bombarded by phone calls and threats from DT Credit Corporation claiming to repossess my car even though I have been making the payments I agreed to, and more importantly THEY agreed to. I have the canceled checks proving this and I have emailed this information continuously to at least three different collectors from DT Credit, but its as if these people have no ears. They have even started calling my daughter's God Mother in another state to tell her that they are going to repossess the car and asked HER to talk to me about "paying my bills". How can they give MY credit information to someone who isn't me? This is illegal! Not to mention that me not paying my loan back is a LIE!
They do not care when I tell them that I only get $330.00 a week and that after rent, insurances, and food it is a MIRACLE that I can send them the $100.00 every two weeks, but I do. They take and cash every one of these checks, yet they are STILL constantly calling and now trying to take the car back that I need to get to doctor appointments and job interviews. I have tried to call the manager who agreed to the reduced payments, but she now seems to "not be available" anymore. I have since refused to speak with anyone any more and have asked that ALL communication be in the form of either an email or a letter so that I can keep tangible proof of what is being said, though I have yet to receive anything in writing one way or the other.
I have since learned that DT Credit makes a habit of selling cars, taking the money, then taking the cars back and still charging people the same money still owed on the cars, but then re-selling the same cars to some new unsuspecting person in bad financial shape. Drive Time is trying to double-dip by taking the cars back when people can't pay, but then suing them for the same amount of money that they would have paid to keep the cars.
How is this legal??? It makes far more sense to work with people until we can get back to the place where we can start making the payments again while keeping the cars that can get us to where we need to go.in this economy, every other car dealer and creditor is trying to work with people since so many of us have LOST OUR JOBS! At least the legitimate ones are.
Drive Time, DT Credit, whoever they call themselves now, all need to be stopped and I would LOVE to join a class action lawsuit to make this happen.
