Misrepresnted their terms of agreement and stole our $895 deposit! Starting a class action suit - contact me if you want to join!

We contacted Realty Trade in November to sell our time share in Florida. At the time the contract said that "they would forward all inquiries about our vacation property directly to me and allow me to negotiate the sale."

If we did not receive a reasonable "offer" within 6 months they would refund our $895. When the 6 month time period ended I called to find out the process to have my deposit returned. Miraculosly they said they had an "offer" (they also said that they had previously sent me 3 other offers that we hadn't responded to. A friend of mine is a Computer Technician and checked my computer and assured me that we never got any emails from them - the address would have been network. [email protected]). They sent this "inquiry" to me - basically a letter with the email of a person (the email was incorrect and when I called back they kept me on the line for about 20 minutres and gave me a new"hotmail" email address) and a budget price. I contacted the person that had "inquired" about our property and received no response back - SURPRISE!

We then sent (certified receipt) a request to get our deposit back. I have called multiple times trying to get information about our refund with many different answers. When Don Biggs sent us an email in the beginning of this whole thing he said to call him anytime with questions. Everytime I have called Realty Trade they won't let me talk to anyone but customer service saying that the folks in Marketing do not take calls.

I think a "reasonable" offer means that it is actually an offer not an inquiry.

When I called today and spoke with Cassandra and she informed me that our request for a refund was denied. I believe this is false advertising as I did NOT recieve an offer, I received an INQUIRY and I believe with all of my heart that it was a fictious person. We wanted to sell our timeshare - why would we not have responded - it makes no sense! Had we not run into all of this red tape we would have continued to have them market our timeshare.

I have now researched this company and have seem numerous complaints that are the exact same as mine. If they do not return our refund and contact us by Monday, 8/10/09 we will begin a class action suit. We have already obtained an attorney.
