I am just another sucker that fell for Mr. Diaz's promise of a loan modification as well. He was hired in September and our home went into forecloser on the 3rd of February with no contact to our Lender what so ever. I have been going back and forth with him regarding the refund of my money, Which was promised by Mr. Diaz thru the BBB to return and he went so far as to send me a check for half of the amount he owed me.
Stating in the memo line 1st Installment of 2 and not to cash it until May 30th So I held on to it until then, I called his bank a couple days in a row after that date to check the funds and they were insufficient, So I did some legal research and found a way to have the bank monitor his account and pull the funds when they became available and they did. So if I were him I would just pay me my other half to avoid me taking him to court for much more... Lena, San Bruno, Ca... Not a happy camper!!
