Unlawful and un-timely actions of dfps texas (department of family & protective services)
On nov 1st my step children were removed from their biological father in odessa tx, due to psyshical neglect, and pending 2nd degree felony charges for the assualt of his 4 year old son. He left bruises and broken gums due to kicking his son repeatly in the face. Dfps was called and took removal; procedures, they placed the 2 kids in a foster home in midland tx until dec 12th, when they called me and my wife to take custody of her own kids. Dec 18th the kids were placed in our care, wish we greatly appreciated, since they were released to their biological mother, well, dfps continued to make home visits and all until march 19th. Then the dfps worker asked my wife if she wanted to take full custody of the 2 kids, my wife explained that we did not have the resources to hire an attorney, so the dfps worker explained they could file for custody away from the father, it would seem that they was taking custody from both but it was the legal blah blah blah, they needed to do... And the kids would remain in our care and we would get custody of them, my wife agreed to this arrangment, aand soon the case was in court, we traveled over 100 miles to be in court, only to wait for an hour and then be told that court had been reschedule for the followin week, we went to court on apr 29th only for the judge to be asked to step down and to get a replacement judge, so the cps worker said to us they would file a emergancy removal so the kids would be taken away from the father, but assured us the kids would be in our care. So we agreed (like a fool) to this and they proceeded with it, when we got back home the same cps worker was waiting at the house with a uniformed officer to remove the kids from our care. They removed the lkids from our care for the remainder of the court case and placed them in a foster home 50 miles away. They are my kidss too, and dfps lied to us. Ok, while the cps officer was here my youngest biological daughter choke on some food in front of the worker, i promptly performed the heimlich maneuver on her and dislodged the food, the worker said we did great and the house was in great shape and we had nothing to worry about, well today 5/1/09 cps came with a report that was called in from that case worker stating we neglected and put the baby in harms way, because she choked, so now they are trying to remove the only baby left in the house... But now the story gets better. I have 2 kids in the custody of my ex-wife. I have reported her for neglinence for the past 6 months due to her not taking our kids to the dr, and attend8ing to my youngest special medical needs, she has to be in rehab weekly. Well, everytime cps investigates, the case is closed within 2 days stating - no evidence could be found. Well starting in jan 09, the father - the ex-husband of my wife (the one that got his kids removed by dfps) moved in with my ex wife, and i made reports about him., well they keep closing the reports and won['t do anything about my two kids being around the same guy that abused his kids and with criminal charges being pressed. Dfps removed his two kids from his house, but they will not do anything about my two kiods being with him. They keep harrassing us, we love opur kids, we never spank them, we never neglect them, we pay our fulla ttention to the kids at all times. But we keep getting harrased by dfps this has been going on for 4 years.including my baby being taken away at birth, becauise of a positive drug test, (but the hospital failed to report they gave my wife drugs that would pop a false positive for drugs) even after dfps had proof that the hospital gave her these blood pressure pills, they still kept our baby away from us and placed her with my ex-wifes sister 30 miles away. And kept her from us for 6 months before finally releasing her to us only after the judge ordered them to... But yet they won't remove the kids that are in danger from a guy they arrested for abuse. It is unfair the way they do their investigations or removals... They say one thing and then do another, we have been lied to numerous times, and my kids are still in harms way because of cps closing the cases without investigating them...
Please sign this pitition, so i can take this to the court to get them to reopen the investigation for my kids, they are only 2 and 4, they need to be safe, and we need to get all of our kids back home with us... The other 2 kids are 2,6 and 8... They miss us and are not allowed to see us until the court is over. Please help us get our kids back from the unlawful removal of the oldest two, and the failed half investigated cases of the youngest two, and help us keep custody of our youngest daughter..
We can provide proof we are good parents, we do not have a history, we have complied with dfps request, test, and counseling. We have passed all test, drug test and everything they have given us, the worker today said nothing was wrong with the house, that she dont know why the worker reported us. The police officer even stated that nothing was wrong with the house and that my 2 kids should be removed from the abusive man they are with... But does dfps care - i have to say no... Because if they did, they would return the kids to the parents that love them the most. Even the kids told them they dont want to be around that guy, and they want to stay with us, they have told counseler and dfps this stating they fear going back to that man, but dfps continues to go againt their wishes and i thought dfps suppose to work for the childs best interest.in this case they are going agaiinst what would be good for them. They have switched schools in the past school year 5 times due to cps placement... Please help!!!
