Refusal to fix new home per contract - lien on land beyond agreed amount

My mother purchased a mobile home park in 2005. We decided to put a house on a portion of the property so that we could manage the park better. The problems started days after signing the contract. Prior to the first payment we got calls from Vanderbilt threatening her and at the time there was no house let alone a payment even being due. They tied up the whole property vice the acre agreed upon.

When the house (two story modular) was delivered and set up things did not go as we were told. Shortly after moving in we did our walkthrough making a list as stated by the contract. They sent out a couple of boys to fix the problem. Well, they did some of it then left. This went on for months till finally they decided that there was no money in it and stopped coming. The A/C & Heat isn't right, the roof is pulling apart where it wasn't installed correctly. The siding was not do the correct way. A/C unit does not match each other as to why we are having problems plus high energy bills. The floor is buckling with nails popping up under the carpet. Everything is pulling apart from the walls - crown molding, fireplace front, and the walls are cracking.

We submitted our one year list for punch work and they refuse to do so. They don't even take calls anymore. We did what we were supposed to do per the contract but they have abandoned us, the customer.

Vanderbilt mortgage sent my mom a bill last year stating that she did not have home owners insurance. She stated that she did have it through her own company and faxed them a copy of the paid invoice. They called back and stated that they were going to add insurance to the mortgage charging 10% of the loan because it wasn't through an approved insurance. Now my mother has had several homes over the years and has been with State Farm for over 40 years with home owners and auto insurance.

Well, the next thing she received is that her escrow was off and they were raising the payment by $100 a month. They could not give a reason why! She pays the taxes each year herself along with the insurance so what is left to have an escrow for? Then when she went down to the courthouse to check on paperwork for the park thats when she found out that they had tied up the whole acrage for the home. Not only that she put down $20,000 also for a downpayment. What is not adding up is that the mortgage is almost $1100 a month on a loan that is $133,000. They still have not sent a payment book, interest statements so she can file with her taxes let alone return calls.

We have several home inspectors come out along with appraisors to look at the house. The place is valued at less than what is owed due to the problems with the home. We have a list from the inspectors but no one to help us with this.

We did everything that Clayton Homes asked us to do per the purchase contract.in the end they can't blame anyone so they just don't answer the calls. We have contacted an attorney but that was a year ago and was told that anyone that buys a mobile homes signs (in fine print) a mediator clause. This means that you agree to mediate any problem plus signing states that you can't sue. The mediator is of their choosing not yours so you can see how it may turn out.

My mom is 75 years old and does not deserve this. They have stolen from an old lady who is also raising my brothers two kids when he passed away. She lives on a fixed income so she doesn't have anything to fight with.

I see many, thousands of complaints, that read pretty much the same way. I think that if we band together and take a stand there might be a class action suit in the making. I am interested in taking this all the way to the White House if need be to have this all rectified. I would be willing to help out anyway I can with anyone else that is willing to take a stand with me.

I also see many families in much worse condition than us and know how hard it must be. I am already planning my next move and believe me it doesn't stop with this posting.
