Winfield Security Corporation
Wrongful Termination, Terminated for no reason, Terminated for a false reason, Someone more flexible was needed

My name is John Doe and I was terminated by Winfield Security Corporation in late 2008. My division is contracted with Newark Housing Authority, where I worked at a Command Center in Newark, New Jersey and I had an excellent pay rate. I had already surpassed my 90 day probationary period.

My job involved supervising, dispatching field supervisors, and console operating of the various Winfield Security guard locations. There were two Console Operators per shift and we were also responsible for obtaining guards for replacement in the event of no call/no shows. My co-worker and I have always managed to fill the posts, which was very difficult for our particular shift and we never received any complaints from brass.

Mr. Johnly B., who is the current Account Manager, was hired in August/September of and took over the scheduling of the S.O.C. Employees from Mr. Jermaine James.in August/September, my co-worker and I had our 5 day work week cut to 4 days without an explanation. Everyone, including all three new hires received 40 hour work schedules. My Thursday night spot and my co-workers' Monday night spot was given to a younger, newly hired Console Operator, yet no more Console Operators were needed. This person was hired initially as a Field Supervisor before being placed in the Command Center, and was one of two Field Supervisor's familiar to their own immediate boss prior to getting the job.

Mr. Johnly B. Arrived at the Command Center that morning, told me that he needed someone more flexible, someone that could do the job better, and that posts were not being filled under the night shift. There were two Console Operators per shift, yet I was solely blamed for everything, including a guard that slept on post (even though that guard was written up several times by the entire night crew and Mr. Johnly B. Was notified). My other co-worker kept irritating me that entire night by telling me continuously that I had better let Mr. Johnly B. Know my availability, and that Winfield Security did not want us to have other jobs.

As always, he didn't do any work the entire day, knowing that I would be terminated. I let Mr. Johnly B. Know my working flexibility several weeks ago and I called him two days prior to this to ask him about covering Thursday and Friday night posts that were open for this week. I was also going to let him know that I was now available the entire day on Fridays. He indicated that it was too late and that he needed me for Saturdays and Sundays only. That was never communicated to me prior to this, and I was granted Friday's and Saturday's off from the Vice President and Mr. Jermaine James, and I worked at my other job on those days (until my other job cut Fridays from my schedule). Prior to this, Mr. Johnly B.indicated that he had no problem with me having another job when he took over as Account Manager. Also, he never indicated there was a problem with my flexibility, post coverage, or attendance.

I was never evaluated by Mr. Johnly B. And I have only met him in person twice for training (Employee Scheduling). My co-worker and I had log-in privileges with this system (along with everyone else), but we were the only members without assigning privileges (or removing and adding another employee's name on the schedule and several other privileges). We told Mr. Johnly B. Several times about this. We were all Supervisors, but the morning crew would have to do this for us. I never received verbal or written warnings about my performance, which should of been proper procedure (to be evaluated, as per the handbook). When I was hired, Winfield Security had no problem with me working my second job, which I cut to part time and changed around because I was initially told that the shift started at a different time. I was rarely ever late and never missed a day of work.

My co-worker and I finished our shift one day this past summer, and my co-worker gave Mr. Johnly B. A call to inquire about receiving a 5th day because of his schedule reduction. My co-worker was told that he was not filling in posts, which was not true because we both worked together practically every night before the new hires came aboard. My co-worker then told one other Console Operator (who had just arrived to relieve me) what Mr. Johnly B. Had said. That person also indicated that that was not true at all. There are paper and computerized records of all posts that we occupied.

I have always performed every aspect of my job and I was very dutiful, as I have rarely ever left my post to go to the restroom or get a snack. My initial co-worker and I never left the building, which was not allowed. Yet, the two newer workers that worked the night shift with me continuously left the building to buy food and go to the gas station. Two of the three gentlemen I worked with would always sit on the left side, and paid no attention to the cameras at all. One of them would do that in addition to being on his laptop and playing his music CD's. After our schedules were reduced, my co-worker and I were working with a different person practically every night. I cannot understand why (my co-worker and) I was targeted and terminated under false, drummed-up charges.

I did bring this to the attention of Mr. Jermaine James and the Vice President, who were both Mr. Johnly B's bosses. Mr. James indicated that he was no longer in charge of the schedule and that he never had a problem with me. He also said that he did not know what Mr. Johnly B. Was doing. I also told the Vice President what occurred, and by the time he called me back, he said that I was late several times in the beginning, not filling in posts, and that Mr. Johnly B. Can run the account anyway that he wants. Again, that is not true.

Mr. Johnly B. Is a police officer and seems to only keep around employees who are studying to become police officers, Newark Housing Authority relatives, former police officers and friends of his (and friends of his Field Supervisor) that he's hired. I was never written up or received disciplinary ation. It seems to me that he may have been using my co-workers to evaluate me. He cannot do that and I have never done anything wrong.

All I have ever asked for was to be treated like a man and a human being. If he really needed me, all he had to do was tell me, and I would have resigned from my other job. I have worked hard in the security industry for 10 years before getting to this point and I am baffled as to why I was embarrassed, humiliated, and treated in this fashion. I have worked for and earned everything I have and nobody has ever given me anything. I do not play politics. They cannot continue to do this to people and get away with it. Please advise me if there is anything that I can do about this, such as receiving back pay and/or my job back. Your help and response in this matter would greatly be appreciated.

Yours Respectfully
